Hi all,

 

I just posted my AOS based upon marriage to my wife, which is a U.S. Citizen through birth. I am currently in the USA on a J1 Visa, that expires April 30th 2018. I am currently employed until that same date.

May 9th me and my wife are traveling to the Netherlands to celebrate our wedding (intended stay there for about 2 weeks). I realize that this is relatively soon (< 4 months) and that we may not be able to get approved for AOS in that timeline.

 

My boss told me in principle I could work for another year at the same University, but I am curious if I would receive the EAD/AP in time for me, due to our international travel. If not, this would require me to apply for another Visa in the Netherlands...

 

Another question I had is regarding the new tax year: We just filed and my wife only put evidence of her 1040, W-2 and 1099's from 2016 as recent year. However, just TODAY new W-2 forms were handed out for both of us and I am hoping that they won't send out an RFE to ask for 2017 tax year.

 

I am curious as to what advice you guys have! Thanks.

AP and EAD takes around 4 months right now so it could get pretty close to your planned departure date. However you can expedite based on job offer (or current job) to be able to have your EAD (and thus also your AP) by May 1st.

Oh and they won't give you an RFE for missing tax documents for the most recent tax year. They tend to give RFEs for that if you file late March or April without the current tax documents. I was a late Feb filer  (2017) and it seemed to me that in our thread I belonged to the very few people who had also submitted the current tax return. None of the others got a RFE for that.

How would this work, and is this a process that takes some time/effort too? Could you give me a starting point to do this?

So I got my biometrics done on Februari 28th, but my travel date on May 9th is coming closer and I have not heard of the advance parole document. I have called to expedite, but did not hear anything. Are there any other things I could do to make sure that my application is not abandoned?

Hopefully some other people in a similar situation could help me out.
