Border Patrol, nevertheless, cannot pull anyone over without "reasonable suspicion" of an immigration violation or crime (reasonable suspicion is more than just a "hunch"). Similarly, Border Patrol cannot search vehicles in the 100-mile zone without a warrant or "probable cause" (a reasonable belief, based on the circumstances, that an immigration violation or crime has likely occurred).

 

It is a catch-22. They can operate the checkpoints (and we know they do), but they cannot search your vehicle without a warrant (which they can't have) or probable cause (which usually they do not have).

In other words: they are useless and they harmful as they turn us into a police state since most citizens do not even know their rights and have a inherent fear of police or federal agents.
