EVERY CBP checkpoint I have been through they have a dog that casually sniffs each vehicle for whatever. So yes if they get a hit they will have "probable cause" to search your vehicle. You take it to court and you WILL lose.

Then someone had better inform every CBP district that's been violating this rule multiple times daily, as routine practice, for many years.

Any judge will dismiss the case because of the unlawful search. An unlawful search is inadmissible in Court and can't be considered probable cause.

It's the other way around.

It's the US Constitution.

If there are CBP officers behaving this way (and we believe they are) then they are being allowed to do so unchecked. Therein is the danger. They have an important job to, but I think instances of their behavior show not all of them do it to the best of their ability. They should be held accountable when they are wrong. I don't think our government takes accountability in these aspects seriously... and that's disturbing. My husband has only had relatively fair and 'nice' experiences with the CBP so far. I gather it is vastly different elsewhere.

CBP agents only have jurisdiction when you are crossing a border (they can strip search for no reason).

Otherwise they are bound by the IV Amendment of the US Constitution.

Do they routinely violate the Constitution? I don't doubt it at all. Some people do fight back though. We should all do.
