Hello all!  Thanks for you help in advance.  I filed the entire AOS package from being a k-1 January 10.  The package arrived in Chicago lock box and I got text receipts for the I-485 and I-131 today.   I also had sent in the application for EAD (employment permission), but I didn’t get any text receipt about the case number of this application or if it has been Received.  Is it normal not to get all the receipts at once? HAs this happened to anyone else?  I sent them all together, so I don’t understand why I didn’t get three receipts.  Thanks!

Happened to me. I-485 and i-131 were accepted, i-765 was rejected. They claimed it was because of "wrong fee" which is funny since the fee was correct and they accepted the i-131. Once you receive the i-765, correct any issues with it and send it back. It'll be a little delayed of course but nothing worse than that.

Don't forget to add a copy of the NOA1 for your i-485 when you resend the i-765 package, so they know you have a pending i-485 and therefore should have the i-765 for free.

 

I also added print outs from USCIS website and highlighted the parts where it says i-765 is for free when you have a pending i-485. They accepted it just fine the second time.

Thanks for the info!!  It sounds like it shouldn’t be too hard to fix this situation (hopefully)  Actually now I have another quick question——did the delay of the EAD cause a delay of the AP too?  I know they usually come in a combo card, and wasn’t sure if the delay of one caused a delay of the other.  Thank you!

They could isuue EAD and AP separately,  so there are possibilities it won't delay AP

My EAD got delayed with about a month because I had to start over. The AP wasn't affected, I still got my AP on time and then my EAD a month later.

Paper. You get two AP in the envelope, good to have an extra if you happen to lose one of them.

So it turns out you were exactly right---I called today to check the status (got NOA for 485 and 131, but nothing about 765), and They said I didn't pay the correct fee!  When you resent the i-765, did you have a cover letter?  Did you include the receipt number from the rejection notice and explain the situation in the cover letter?  Thanks!

When I sent the initial package I had one cover letter for each application, so when I resubmitted my EAD application I sent the same EAD cover letter I had already sent before, but added the NOA1 for i-485 to the list, and also a copy of the rejection notice (I always keep all "originals" of everything), and some "proof" from their own website stating the i-765 is for free. So no need to write down the receipt number anywhere, it's on the rejection notice in case they need it.

 

I didn't explain anything in the cover letter, I just took screenshots from the i-765 instructions and other parts of USCIS website where it clearly says that the i-765 is for free if you have a pending i-485. After I printed the screenshots I highlighted the important parts, making it as easy to see as possible.... Also, in the rejection package they sent back a list of the correct fees, funnily enough it clearly states under the i-765 fees that the fee is waived if you have a pending i-485 - so I sent that fee list back too, and obviously highlighted that particular part.

*nevermind, you didn’t have a case number. 

I actually called to check the status and they gave me the case number and told me it was rejected.  I got a rejection notice yesterday in the mail.  Apparently I also used an outdated version of the application.  The rejection notice said it was rejected for lack of fee payment (clearly their error since no fee is needed when filed with AOS), and that I used an old version.  I had downloaded the form from the site, but I guess they updated it in the time between when I downloaded it and when I sent it in.  I just sent a new package with an updated form and my NOA1 for the I-485.  Fingers crossed it works this time!
