While I will try my best to sound as objective as possible regarding your situation as I'm a May filer (May 23rd received date) and today makes 247 days of waiting for our NOA2 with no RFE being sent, the only real piece of advice any person can give is you have to do what you and your fiancé feel is best for you. If you are going to get married in February, then you need to submit signed withdrawal letter to USCIS asap because it takes time for them to receive it, review it, and respond with withdrawal the petition. While the CR1 is cheaper than the K1, keep in mind that since you already started the K1, you're gonna be paying more just for the whole process to get your fiancé here to the US because you just paid the $535.00 for the K1 and there's no refund. Secondly, you just waited 6 months thus far - it will take approximately a month or so for USCIS to withdraw/cancel the K1 petition, then you get married and then you have roughly another month because you will need the marriage certificate (must be in English translation) which is another month and whatever additional documents to file and pay the CR1 fee. Typical CR1 timeframe can range 13-18 months and that is based on straight through processing - meaning, no delays, no hiccups, no RFE's; therefore, it can take longer. While your fiancé who would then be your husband will get his GC, employment card and other governement docs after approved at the interview; which is great because he will be able to work as soon as he comes to the US - the question you need to decide is what is more important to you two right now. Is it more important to get married on Valentine's Day because the day itself symbolizes love and you can celebrate your anniversary on the same day as Valentine's Day (which is fine but keep in mind next Valentine's Day you fiancé or husband if that's the route you choose, he will not be in the US to celebrate ya'll first anniversary together in the US). Or is it more important to you both to keep going with the K1 visa process since you've already waited 6 months thus far?

 

What this comes to for both of you is what you want v. what is necessary and makes sense. Remember, Valentine's Day is just a day. The wedding is just a day. It's the marriage that goes on every day for as long as you both want it to.

A friend of a friend applied for a K1 Visa.  Planned the wedding. And still hadn’t received NOA2 by the wedding date!!   Even worse they cancelled the wedding the day before!  

 

When end they tell you not to make any plans before you’re approved they mean it.  It’s hard as hell to wait.  And it’s often months before you see anything.  But I’m thankful for this online community where we can all share our experiences.

My baby with my American citizen fiancé was born recently in Canada. We filed in September and I’m still in Canada with our baby waiting for my NOA2 while my fiancé comes up every weekend to see us. Not that complicated. We went to the Embassy here and got her a CRBA (Consular Report of Birth Abroad) which proves her American citizenship. I’m glad she has dual. It’s only complicated if your child(ren) are not the biological children of your American fiancé in which case they require a separate K2 visa. My daughter is a citizen of the US through her father and therefore does not require a visa.

SO 6 months since NOA1 and I am still waiting for approval. Hopefully soon? Anyway I just realized I have no idea whats next? My friend who is petitioning for her husband had to pay a bunch of fees when she got her approval. What should I get ready for. Someone told me I do not need an affidavit yet. What comes after NOA2?

Yes.  After NOA2 you will create the DS-160 and pay the visa fees and medical.  Get police certificates and other specific submittals required for your location.  You are Day 180 right now so it can be almost anytime this month if you are lucky.

 

You do have a little time between NOA2 and the interview to do everything them but some police reports have a long lead time.

 

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.
