Canadian applying to B2 visa?

I got a hard denial at the border a year ago. It's a serious enough blemish I have to report to secondary every time I enter the US. 

 

It's all the luck of the draw unfortunately. I have crossed a total of 4 times since. The first time was the most stressful. I brought a binder full of ties back to Canada. I was bluntly told the biggest thing I had going for myself was the fact I was completing the immigration process legally. I gather you are not proceeding with a green card petition of any kind?

 

It's tough to overcome immigrant intent. I brought everything I could think of. Proof of school, son's school, appointments, car insurance, lease, phone numbers with a list of people the border could contact, Facebook conversations saying I was coming back, bank statements, etc. I wonder if I would've been approved had my 5 year old son not been with me. There were a couple agents that looked a little leery but approved my stay.

 

As others suggested every time I traveled I went through a preclearance airport. I found it's better that way and I tried to mentally prepare myself for a denial. I always told the border agent I respect their decision no matter what. They don't want to see desperate people.

 

One question I would be prepared for is why is it so important you travel to the US? Especially with a risk of denial?

Being that you have no ties to Canada since you do not live there anymore I would think it will be harder to enter the US from there.

 

Also showing up at a land crossing after a flight into Canada with a B2 to enter the US will bring all sorts of questions. It would be safer to do Pre clearance closer to you or fly directly to the US. Trying to go through Canada even though you are a citizen will still look like you are trying to hide something. 

 

Also what are your ties to your new Country? Are you a citizen there? Getting a B visa in another country then your own can sometimes be harder.

@Ontarkie Hey! thanks for your reply. I wasnt planning on going to Canada first, and then go into the US.

 

I have lived in the United Arab Emirates now for 5 years, so I have plenty of ties, from employment, to cars, to a house, to  bank accounts ,and same goes for my husband who is American.

 

I can definitely try to go through the Preclearance here in Abu dhabi and bring all my documents, but I wonder what happens if the deny me? I just walk away or they withdraw me?

Were you ever denied at preclearence, and if so, what happened? 

 

I have all documents to support my ties, car ownership, bank accounts, letter from employer, tenancy contact and more.

 

I will eventually apply for a green card once my husband and I decided to immigrate to the US, but for now, we are happy and love our jobs in Dubai, so all we want to do is go visit his family in the US for a week.

 

 

@Lemonslice i understand, i was just asking if you are denied at preclearence, what usually happens, thats all

I'm glad you have plenty of ties, that will will a lot. 

 

As for what would happen at pre clearance is anyone's guess. We can't say what will happen, my best guess is they allow you to withdraw. You are already flagged from your previous issues at the border that flag will always be there even with a B visa. That's why you need to to have strong ties.

I was denied at a land crossing. As a consequence my name is flagged at every port of entry into the US. I was told repeatedly that only agents in secondary have the authority to approve my entry so I always get sent there for an interview.

 

In most cases you can withdraw your application in preclearance. But that's in Canada. I am not sure what kind of arrangement is offered when you enter from other countries. It depends on their relationship with the US.
