Here's the thing.  My wife's parents has hired someone in China to guide them through the interview process.  They've asked me something about an employment letter.  Will the immigration officer at the interview ask them for an employment letter?  It doesn't make sense to me because they haven't even entered the US yet.

the employment letter is optional, if you have it, it's an additional proof, but not mandatory

 

if you have sent your taxes, w2s and paystubs, the employment letter isn't necessary, you can send it if it will ease their minds

 

it's not their employment letter, it's yours, as part of the financial evidence of the i864. but as said, if you have other evidence, then it isn't mandatory, it's part of the evidence that you can send

One last question as i'm going to send my in-laws their package that they will bring to their interview.

 

As i've mentioned my wife petitioned her mother and father.  What visa category do they fall under?

We received great news.  Their petitions have been approved.  They received their visas and my mother in-law will come to the USA first while my father-in law will stay for a few months to take care of their 17-year old son.  Once my mother-in-law comes to the USA, she will be granted her Permanent Resident Card.  What form do we fill out to petition their brother?

you mean their son right? the 17 year son they left behind? the same form, the petition is similar to the one you sent for your in laws. the difference is that it will take 2 years for them to bring their 17 year old son

 

so she starts by sending the i130, documents and payment

 

her husband must enter the country before the visa expires

Hi,


My mother in-law has been in the USA since May 3, 2018.  When can she expect to receive her permanent resident card?  It's been almost a month.  I've heard people say that it should take about two weeks.

did they pay for the card? the card can take from a few weeks to months, that's why she has the i551 seal in her passport valid for a year, which proves that she is a resident until she receives the card in the mail

Thank you again for your response.  I believe we paid the applicable fees during the process.  Do you think that we can go ahead and fill out the form i-130 for her son without her permanent resident card?

the card is after the process, once she got the envelope, it had the instructions to pay for the physical card. was anything paid after she received the envelope from the embassy. the card is $220. the card can be paid before entering the country or once she got here.

 

if the card wasn't paid, then she'll never receive it

 

yes she can start the process now, she can prove that she is a resident with the i551 in her passport. eventually she will need to send a copy of the GC

 

but for now she can fill out the i130 and send a copy of the i551 in the passport

I'm helping my mother in law fill out the form i-130 for her unmarried son.  I read the instructions.  The only evidence required to send along with form i-130 is a birth certificate with the sons name and her name.  This seems straightforward.  Do you think any thing else is required to submit as far as evidence?

birth certificate of the son, and copies of marriages or divorces of his mom, plus the proof of being a resident any document not in English needs a translation of said document attached to the copy of the original document.

Thank you.  I have all that.  What is proof of being a resident?

My mother-in-law was petitioned on form I-130 and was approved.  She went through the process and finally immigrated to America.  We've been waiting for her green card to arrive in the mail.  We were provided with a USPS tracking number which said the package was delivered on July, 6, 2018.  Today is July 16, 2018.  We've called the local USPS office and they're confident that the package was delivered to our home and said that there's nothing else they can do.  

 

We did not receive the green card.  I told the USPS that their explanation leaves me with no solution.  What can we do?  Can we get a replacement green card?  How long will it take?  How much money will it cost?
