My fiance will be in US in the next month.  We are talking and planning our wedding and honeymoon.  We would like to go on a cruise.  I had thought about going to Alaska but all of the cruises i have found to Alaska also stop in Canada.

At what point and time can your fiance/wife go on a cruise?  Is going on a cruise really considered leaving the country?

You cant leave US unless you have your Advance Perole during your AOS process.

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

Yes it is considered leaving the country because you go into international water

For a US Citizen you don't need a passport since most cruises are considered a loop tour.  Which means you start in the USA and end in the USA, just like all the one that leave from FLorida or Texas and travel to other countries.

 

But for a person on a K1 I don't think it would work, but I haven't ever read of someone trying it.  Sounds risky to me.

Just when you think you have TDS eradicate,  a new case shows up.

This is actually a pretty regular question here on VJ and hopefully you didn't already put money down for a cruise. Some people come on here only AFTER they have paid for the cruise only come to find out that their SO can not go on the cruise.

No you do not want to do this Cruise at all. I did it with a USC SO in 2009 as well. On the way going, you get off in Vancouver, BC and go through Canada Immigration. On the way back, even for USC, it was complicated. We had a return flight to New York City, from Anchorage, AK via Vancouver.

 

They had us going round in circles, checking back into Canada, then out of Canada, then US Immigration in Vancouver. Better safe than sorry

 

PS: Not the scenery you want but what about the area in Seattle? The San Juan Islands have great scenery then take a Cruise down past Oregon, and end up in LA? Look at this site which might help.

There are some Hawaiian cruises that don't leave the US.  My husband and I looked into it for our honeymoon.  

 

That and the river cruise mentioned above are the only ones I could find that didn't leave the US.

The K1 visa is for one time entry / going out of any port in the US is considered international waters  3 miles out

you need that AP card to get back in the US / without that, you are looking at starting the whole process over and this time it would be a CR1

my brother-in-law wanted to do the same from florida with his in laws as they were coming for the weding / the new wife was not allowed on the ship in Miami as she had no visa to return

Someone suggested a Hawaiian cruise.  Someone else said if you enter international waters (3 miles out)you would be leaving the country.  So that would mean the Hawaiian cruise is out as well.  Is that correct. 

No i didnt purchase the cruise tickets.  The K1 process has taken so long and been so frustrating I would not want to go through it again.  So do not want to jeopardize there status.

 

How long does it take go from K1 status to green card status.

 

Thank you all who have given your advice.  It is much appreciated

We wanted to do exactly that, an Alaska cruise out of Vancouver, but ended up realizing that wouldn't work and cancelling the reservation (and got back full deposit -- not sure why, but no complaining there!). Instead, we chose to take a long-distance train trip across the USA. Kind of like a cruise... seeing the scenery roll by the window... Just throwing that out as an option in case you're interested. We had a blast!
