So people cannot have an opinion on our current immigration laws?  I am not a big fan of "chain migration", but in the upper forums I would still give people valid advice about bringing family members over.  Having an opinion on a current laws does not mean someone is against something.

Things we do know: he is living here legally. However at some point in his youth he was either convicted or pled guilty to a minor charge, which I assume would be a deportable offense even if it was stupid as could be. According to WaPo - the reasons for his apprehension is due to his original charges when young. By all accounts they are so minor - at about $100 in destruction of property (the second charge was expunged from his record - but it too was about $100). So this begs the question, shouldn't there be bigger baddies out there to go harass and remove?

 

His sister who is a USC believes their mother may have become a citizen at some point, so there may be legal avenues they could pursue. He had thought about becoming a USC soon, but I wonder if that would have been possible given his prior history.

 

 

No wapo is giving a theory as to why he was detained. If I was to hazard a guess, after reading several stories, it was because he was given an order to appear and failed to do so.

I would have said theory or guess if the article did not expressly mention this was the reason listed on his notice to appear. They could have used a speculative phrase, but they did not in this instance. I would have also assumed the same as you did, however it doesn't mention for instance if his notice had been received prior and that he had failed to appear at it. If that was the case I'm sure they would have mentioned that, with a sympathetic reason as to why he failed to appear. No evidence of that so far.

Would the USC wife be able to petition for him again, should he get deported?

 

Because it sounds stupid to me -> Green Card holder deported , then USC wife filed AOS/I-130-> Get Green Card again.

Circular motion. Might as well let him stay.

Then how can someone defend this guy?  I know, the offenses seem minor, but rules are rules and laws are laws.  There was a guy in Detroit just deported back to Mexico recently.  He didn't qualify for DACA, and he triggered a 10 year bar when he tried to AOS through his wife back in 2005.  He and the lawyers dragged it out until now, but just a week ago he was sent back to Mexico.  The wife blamed Trump, but this whole thing started long before Trump.  If this couple came on this board and asked for advice how would we respond?  Most folks would be as matter-of-fact as possible and inform the guy that a 10 yr bar was going to happen.  Why not go back in 2005 and serve the bar?  He could have been back by now.

But that is an opinion, based on what he was showed them. ICE has not committed.  If only he had appeared as requested
