Hi!

 

I got an RFE that reads as follows:

"                                                              FORM I-129F, PETITION FOR ALIEN FIANCE(E)

You <name redacted> (the petitioner), filed a form I-129F, Petition for Alien Fiance(e), in behalf of <redacted> (the beneficiary) on June 19, 2017.  You are seeking to classify the beneficiary as the fiance(e) of the a United States citizen under section 101(a)(15)(K) of the Immigration and Nationality Act.  Additional evidence is required to establish the qualifying relationship.  Submit your response to this request for evidence along with the attached blue sheet.

 

DATE OF BIRTH DESCREPANCY

 

You indicated on form 1-129F that the beneficiary was born on 02/13/1981.  You indicated on the form G-325A, Biographic information that the beneficiary was born on 02/13/1980.  Please submit documentary evidence to establish the beneficiary true date of birth.  Such evidence may include her birth certificate and/or passport.  If you submit a copy of her birth certificate, you must submit copies of the front and back of the birth certificate (if there is information on the back)."

My questions:

1)  Are they asking me for further evidence of qualifying relationship AND to resolve their date of birth descrepancy?
                The first paragraph sounds like I need to send more information about a qualifying relationship, but I cannot tell if that's just the same form paragraph they put at the top of every RFE, or if it's another request.

 

2)  The top of the form tells me that I need to send translated birth certificates along with a certification "by the translator."  I have a copy of her birth certificate, and a translation, and a sealed certification by the courthouse in Taiwan that it is a correct translation.  She herself made the translation, so the certificate that it's accurate is not from her.  It's about as official as we can make it, but it's not certified "by the translator."  Have other people used something similar?

 

3)  We got her birth certificate just over six months ago, from the authorities in Taiwan.  Should everything still be considered "valid" or does the document have a de-facto expiration date I'm not aware of.  (It's not like its a document that will EVER change).

Just the latter. You only need to send what they specifically ask for. 

 

I do not have an answer for your other two questions, but would it not be simplest to bypass them both and just submit a copy of her passport instead?

Okay, I will send the passport.

 

Is that just a copy of the top page only?

Also, is there any benefit to sending the passport along with the birth cert and translation?  My overall approach has been OVER-documenting, and I think everything would have been fine had I not messed up filling in the one form.  (facepalm)

Well, providing something inconsistent with the rest of the packet is a risk when providing too much information. I believe the the I-129Fs being accepted in June were all the 13 page versions. Those didn't require G-325As.

That makes sense.  I had sent an older version at the time, and got a notice that they had just updated the form within a month or two.  So, I hadn't figured out that G-325 wasn't necessary yet.

 

My sister's a paralegal, and basically spends all her time avoiding, correcting (and occasionally making ;-)) exactly these kinds of mistakes.

 

I would just call and ask about the details on the birth certificate, but the last thing I expect is having any chance whatsoever to access any kind of information that would be straightforward or useful to anyone at all.  Is my guess about right?
