as we know it the ESTA is no longer an option as Pedro has already done the overstay, and if they go through with the marriage and the AOS is completed Pedro will get his first 2 year green card, if things continue to press on with the pair in a good way, then after 3 years of marriage Pedro can file to become a USC and get an american passport, none of which would make a difference. If you have tried to make things work and they for whatever reason fail. The ESTA is already behind, if the two of them have a boni fide relationship there is no reason that the AOS should not be denied.

 

you can not go on hypothetical, as we never know what the next day will hold, however if there is love let the love flow.

 

Now if Pedro isn't really that in love, and marriage is only to satisfy Ashley there is a problem.

 

Above mention is true however my advice is that now that Pedro has over stayed he needs to think about all things, he needs to decide if he is really in love, and if he can answer yes...Then nothing better than to take a leap of faith.

This is an important part too.  Seriously, if Pedro dislikes the idea of settling in the USA, it could cause many problems in the marriage later on.

The immigration process is stressful enough for people who DO like the idea of being an immigrant.  Add in someone who resents the idea of living in the USA to begin with, who felt pressure to marry, and then all the stress of acclimating to an entirely new culture, adjusting to a new marriage, leaving friends and family behind, etc. it is extremely difficult on Pedro and may cause wear and tear mentally/emotionally.  Visiting the USA is very different than living in the USA.

 

Only you two know your relationship, and only you two know your level of commitment to one another.  Continue to consult with immigration attorneys on the possible consequences of your decisions/actions---and get a few opinions from different ones as not all of them are reputable.

Thank you.That's the best answer so far. ESTA isnt really a concern.Yes he is really in love and wants to be with Ashley, he just worried of the unlikely chance they get denied. How it woukd affect them both and if he could he still get his life back together, that is all!

If in fact Ashley and Pedro are really in love and are set to make it work, that is all that matters, show a boni fide proof of such together, marry, get joint accounts, have car insurance together purchase a home or rent a place together, show that their life has combined and there is no reason that the AOS will be denied. Fact is USC is entitled to have their spouse with them.

 

That is what we are all fighting for her on VJ, if it doesn't work out Pedro can willingly abandon his stay in USA, and go to his own country, now picking his life back up from where it was may not be an option he likely will have no chance to enter back into the USA  unless it happens to make it past the 3 years of marriage and he then becomes a USC holding a USC passport.

 

I know that there have been some comments here but this is a fact of life we all must make our own choices, and being bullied or pushed into one that isn't yours is just that your choice to make, sometimes paths in roads end, somethings they make a change in direction sometimes there are bumps in the road, but all is how you chose to make the choices.

What? You start out saying that you’re being pressured into this, you actually said you were marrying because of the overstay (maybe you meant different but that’s what you said) and yes I’m highlighting the consequences of if things don’t work out, as you say you are asking, and you call it hate? Huh? Whatever.

After OP gets his 2 year conditional green card, he'll need to file to remove condition before it expires. And then he can file to be naturalized. Don't forget the step of removing condition, because if he doesn't do it, he loses his permanent resident status.
