Most lawyers give free consultations---seek a consultation from another one and ask them about the prior visa/hypothetical situations.

Once the AOS is filed, Pedro would be allowed to legally remain in the US while the application is pending.

If the application ends up being denied, and after any appeals have been exhausted, Pedro would most likely need to book a flight home.

I heard he cant appeal coming on an esta, is that true? Also im aware he needs to go home then but will the time he was waiting for AOS accumulate for his overstay?

He overstayed on ESTA.

He is no longer eligible for ESTA for life.

No, as again, he was allowed to remain the US pending approval/denial of the AOS.

must admit I get very confused over hypotheticals but hypothetically his focus seems more on working on the Ships.

Shame that Ashley won't consider moving to be with him as I presume being with him is her main focus too (or should be in any hypothetical love story).  Love should know no country borders.

If ‘Ashley’ can’t commit to moving if ‘Pedro’ doesn’t get a green card then ‘Pedro’ really should reconsider her commitment to him.

Another user mentioned above he isn't accumulating overstay during AOS? Is this true even if denied? Cause i read it would count from the moment the visa expired to avoid people abusing the AOS to have lawful presence in Usa during that period without a "real" AOS.

I also need to check this: do you actually understand the consequences of getting a green card? Not just things like tax implications, but how a conditional geeen card works, what you need to do to remove conditions after 2 years, potential implications on that if you get divorced in the interim, etc?

No, did you read the topic? Why you being judgemental? Not marrying cause of overstay, overstaying to marry like lawyer adviced once they decided to marry. He just concerned bout the consequences if things don't workout, why the hate?
