Dear everyone,

 

 

I am a permanent resident, applying for citizenship in the next month, arrived in the US in 2009.

My son came with a student visa in 2013, and was 12.  He is going to turn 18, in December 2019. SO he wil have cumulated 6 years in the usa.( his English is far more better than mine now :-( ;-) ) 

 

Can he apply for an adjustement of status from Student visa to citizenship. He wants to enroll in the Air Force, and needs to become a citizen. 

IF anyone can give their input on how to handle this situation the most efficiently, that would be greatly appreciated,

but why can't he  join in a couple of years as a resident?

 

once you are a USC,  you can petition him for a green card, overstay is forgiven as long as you are a USC and he entered legally the country and he is under 21, at least for now with the current laws.

  Actually if he leaves before 18  + 180 days there is no overstay.   ( minors do not accumulate overstay )    However he will have to wait 5 years after PR to be a USC by which time the air force may not be as attractive. 

This will not be over quickly. You will not enjoy this.

It depends if your son just wants to enlist or wants to become an Officer (see https://www.airforce.com/how-to-join/prepare-for-success/meet-requirements and click both CITIZENSHIP and EDUCATION):

  • Requirements for enlistment: "CITIZENSHIP If you wish to enlist as a non-citizen in the Air Force, you must be a legal permanent resident with a valid green card or a legal, non-citizen with a valid visa. These spots are limited." "EDUCATION You can enlist in the Air Force with a high school diploma or a GED. However, GED holders must meet the following additional requirements: Be at least 18 years of age Must obtain a 65 qualifying score on the Armed Services Vocational Aptitude Battery (ASVAB) Obtain 15 or more semester hours of qualifying college credit to gain the same eligibility as a high school graduate Note that GED holders must wait for GED applicant slots to become available, and this can sometimes mean waiting periods of up to one year. If you hope to attend college, or are already in college and are looking for financial assistance, the Air Force can help you do so in exchange for a commitment to serve."
