Visitor visa is perfect in this situation, and very simple process, also shorter and cheaper.

 

If you file for I-130 then first of all it's pointless if your MIL doesn't want to live in US. Not residing in US most of the time will make her lose resident status or she might have problems when re-entering US.

He can petition her, but cannot grant her anything.

It takes about a year.

The country isn't a living being that can care or not. COs make decisions based on laws of the country.

I think what was meant is that somebody cannot have both at the same time. As an LPR, the individual is ineligible for a tourist visa. They must lose LPR status first (relinquish it or have it formally abandoned).

It's like asking "How can breath underwater without any equipment?" and then remarking that people are saying you can't do it instead of telling you how to do it. Until you grow gills ("laws change"), it's just not something you can do.

"Note: Visa applicants must qualify on the basis of the applicant's residence and ties abroad, rather than assurances from U.S. family and friends. A letter of invitation or Affidavit of Support is not needed to apply for a nonimmigrant tourist visa. If you do choose to bring a letter of invitation or Affidavit of Support to your interview, please remember that it is not one of the factors that we use in determining whether to issue or deny a nonimmigrant tourist visa."

Thanks everyone for chiming in. I'm really having a hard time digesting all this info when I had originally thought this would have been a simple process. 

I just don't see my MIL getting approved for a Tourist Visa. Of course it could happen but I just do not see them approving her, which is completely screwed up.

 

My MIL was counting on me to help her with this, hopefully my support will be enough for her to go get that visa herself.

One last question...would a lawyer benefit her at all with getting a tourist visa?

 

Thanks to this website and many others, I was lucky enough to get through the the K1 Visa process for my husband & him becoming a citizen by myself, no lawyers help. But maybe a lawyer could help my MIL in this situation...?

A visitor visa is about as simple as it gets, how would a Lawyer help?

A lawyer can assist her in informing her what documents she may need, and give her advice on what to expect may happen (which you can already do for free)....but nothing else.  A lawyer cannot answer questions on her behalf at the CO, if that's what you were hoping.
