Hey there! We are on a K1 & K2 Minor Son) Visa we arrived here in the US yesterday January 20, 2018. My son would like to go back in Philippines to continue his 3rd grader schooling can I be allowed to bring him home in Philippines? How to request for approval of Advance Parole? By the way we planned to get married as early on January 30, 2018,.If ever i will be approved of AP can I still include my minor son of our AOS ? does my son be allowed to be included in the application of Green Card even if he leaves Philippines n finished his elementary education?

 

Please enlightened me on this matter. i badly needed your opinion and your advice. Hoping to hear your replies soon

You cannot apply for AP before applying to AOS. You cannot apply to AOS before getting married. 

 

AP is taking months unless it is an emergency and wanting to go back to finish education is not an emergency. 

 

Why didn’t you do his k2 so he could come in the summer after the school year ended?

Arrived yesterday and already making plans to go back? What was the point of applying? Or of coming yesterday? The visa is valid for 6 months so you had 6 months from date of medical to enter. 

 

If either of you leave without AP you won't be able to come back unless you go through the whole visa application process again. What a waste of time and monry that would be. 

 

You had months to prepare for this move. Months to research how and when you can travel internationally, the conditions of your visa etc. It's a bit late now to realize you've done things the wrong way. Your son will have to go to school here or be home-schooled. It's a legal requirement here that children who live here receive an education of some form.

That's a little harsh.  The one thing I do is advise before they apply that the K1 is not as a good an option as a CR1 for most people.  I do wish people giving advice on K1's before they're applied for did disclaimers on the pitfalls.  Helpful VJ'ers help guide people on getting them without saying it's kind of a booby prize. Too many people regret the conditions of the K1  upon arrival. This OP unfortunately found out the hard way, like so many others. 

 

But to answer the OP's question, if you brought your son over to immigrate to the US, the time to begin the process of immigration is now.  It's hard for kids to start a new school etc, but at that age, they also quickly adapt. 

 

As stated before, you are committed to starting him in school here and now (which is what you signed on for by applying for the visa)  or sending him back and starting over from scratch later.  You don't have other options at the moment.

All of us going through the marriage route to immigration are adults and it behooves us to research everything before making such a life-changing decision as to which visa path to follow. The OP has been a member throughout her processing time so has been aware of the forums here (has also utilized them) and could have asked about this at any time before making flight arrangements. 

 

My caveat is always that the the fastest way isn't always the best way.

I agree with that, and I tell K1 applicants to skip the K1 unless the fiancee is in dire straits in their home country. I also don't see an advantage in delaying starting a child in school here.  

 

I am sympathetic only to the extent that VJ eggs K1 applicants on without explaining the restrictions are hard once you get here. It can kill a relationship and does all too often.
