Filling out the I-129F. My fiancé is not currently in the USA but has been here recently to visit. The form says to only fill out info on his arrival-departure record number if he is currently in the USA (which he is not). But then in the instructions it says “select the box to indicate whether your beneficiary has even been in the United States. Provide the date of your beneficiary’s most recent entry in the United States, his I-94 arrival-departure record number, and his immigration status at the time of arrival.”

 

Just want to make sure I’m correct that I skip all of that since he is not living in the US?

 

Also, just to confirm, for the Multiple Filer Waiver Request Information section...there is no criminal background or arrests. So do I select 5d (not applicable, beneficiary is my spouse or I am not a multiple filer)? I have absolutely no idea what this means. I am not filing any waiver of any kind. Do I select 5d or just leave it blank?

 

And while I have you, also to confirm that in Part 4, biographic information, I’m assuming that’s about ME and not my foreign fiancé?

I am not married! I am engaged and completing a I-129F application for a foreign fiancé. I have no idea what you’re talking about but maybe you can explain? Are you saying I don’t check any of the waiver boxes?

Dude, I was literally quoting what you said. You said beneficiary is your spouse. Read your first post. The multiple filing waiver only applies to you if you have filed any petitions before.

No, the line about beneficiary being my spouse is the text copied from the application for answer 5d. Answer 5d says: “not applicable, beneficiary is my spouse or I am not a multiple filer.” He is NOT my spouse and I’m not aware of being a multiple filer but have absolutely no idea what that means. That’s why I was asking! Guess that wasn’t clear.

The OP seems to be quoting answer 5.d to the Mulitple Filer Waiver Request Information section of i29f - the answer states "Not applicable, beneficiary is my spouse or I am not a multiple filer" - basically it's saying that OP is not requesting any type of waiver as either the beneficiary is their spouse (in which case, yes, the i29F is the wrong form to be filing) OR they are not a multiple filer.

I did the same even though I was already back in japan!

hope it will be ok. I learnt it wasn't needed after starting vj though (38).

I filled mine, too.

 

I figure that since the form and the instructions are conflicting, best to err on the side of doing it rather than risking a delay with an RFE.   I have nothing to hide and providing them that information really only strengthens our evidence of meeting in person, if they can/do look up the i94 record which places me, according to their own computers - within the USA at the time I said I was.

This is true, but then I feel like I’m going to fill that section out incorrectly and that will be a mistake. I guess I can just include the i94 number?
