Hi,

 

My GC is filed & my spouse is on L2 Visa .My spouse is having Hepatitis B from 1999 and on medication from last 5-6yrs(2012).Can this be the reason for denial of the GC on medical grounds.

Currently i'm on L1A.

 

Both myself and my child is vaccinated.

According to this website, Hepatitis B is not listed as a communicable disease:     https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume8-PartB-Chapter6.html

 

Nor is it listed as a quarantinable communicable disease by the CDC or HHS.  Since your spouse is already in the U.S., her medical exam would be done by a Civil Surgeon in the U.S., and the above noted website points out that the regulations noted are for immigration medical examinations conducted in the United States.

Is the medical insurance you plan to provide for your spouse adequate for their condition? The meds for Hep B are super expensive, and so is the routine screening to follow the liver condition. Is your spouse likely to need Medicaid?

Where relevant, the information contained in the medical examination can be used to determine whether other grounds of inadmissibility may apply. For instance, health is one factor to consider when determining if someone is inadmissible on public charge grounds. This factor must, however, be considered in light of all other factors specified by law [4] and in standard public charge guidance. [5]

he dont have any health problem and he is healthy.We do test every year and his reports are normal.I ahve medical insurance covered from my office.Thanks
