The letter needs to be from the petitioner as a sort of guarantee that he or she, (the USC), is still wiling and able to marry the beneficiary.

 

We're re-using the exact same text of the letter that my USC included with the I129F. It's addressed to the USCIS, but with a different date, and of course, he will sign it in ink. You can probably address it to the embassy if you like but just make sure it's dated within 30 days of the interview and has your wet signature on it.

 

Better safe than sorry! :)

I just used a copy of the same one, wrote 'reaffirmed 1/15' then signed it. I guess since tunisia doesn't want to deliver her the documents I already sent her, I'll have to send her another round and hope they get there before the 8th

I honestly don't know if that's acceptable. Maybe it is, maybe it would be fine. I just don't know.

 

All I know for sure is, the government has the power to crush our dreams at any point in this process.  Maybe that's too cynical a way of looking at it, but that's the way my mind works on this process now.  My thinking now is, just give them what they want, exactly the way they want it. I mean, look how picky they are about photos and stuff. People getting RFEs over an off-white background.

 

I can always be wrong. I could be making too much of it. I can't deny that I've become kind of paranoid about nit-picky paperwork and perhaps overly worried during this long ordeal. It's the uncertainty more than anything that gets to me.

 

So, I'm just saying...if I were you, I'd send her a fresh letter by courier or priority post or whatever it takes to make sure she gets it in time so that she won't be denied based on not having a fresh letter of intent.  I can't tell you what to do, but that's definitely what I'd do.

They aren’t going to DENY anyone based on a letter of intent... it’s not advertised anywhere and they can’t deny you for something they didn’t request. 

 

They would simply ask for it and put out the case on hold until you provide it, and then approve the case. Some embassies want it, some don’t. None ASK for it. Simple really.

Vocaledge, that's not the case.

 

I don't know what the other consulates ask for. Perhaps they UK consulate doesn't require it. Perhaps the Tunisian consulate doesn't require it.

 

However, they certainly do require it here in Canada. They ASK for it in their packet 3.

 

Not only that, it's the first item, emphasized with an underscore on the checklist of required documents on Packet 3 sent by the Montreal Consulate.

In addition, there is a poster here, I believe they are April filers, who received a NOID for something fairly trivial. I can't remember what exactly but I stand by my assertion that it's better safe than sorry.

I totally understand your frustration, we are in the same boat, day 215 and counting...

 

It's a difficult wait, and I keep wondering if we messed up with our paperwork as well.

 

But I know there are people in the worse boat, waiting for 240 days+ for NOA2, and wish them the best. Hang in there, we will get through this!

@vocaledge is right, the US Embassy would not Deny the case but will be placed under Administrative Processing.

 

@D and T, you are also right that it is written in your Packet 3 for Canada. You are right to say that it is better to be over prepared than sorry.

 

Usually the US Embassies here in the Middle East will just ask for the papers written on Packet 3. Here in Kuwait, they also require the petitioner's letter of intent as instructed on Packet 3.

I can tell you from my experience, since I am from Belarus as well. As soon as I got my NVC number, I scheduled a medical appointment in Minsk (it took them two weeks to get the papers ready there). When I actually got the letter from the U.S. Embassy by mail that they had received my case and I could schedule my interview, I made an appointment at the Embassy in Warsaw. If you are an impatient person just go ahead and call or email them a couple times per week (they reply within five business days) to find out if they have your case.

We're using his mortgage statement plus a copy of his driver's license. His address is on all of his other information as well, so we're thinking that should be good enough.

i saw a few already who got approved with the same RFE recieved date as ours. No update yet on our case :(
