I put "Yes" for this question and then explained in the comments that "my fiancee applied for a K1 visa on my behalf in July 2017"

NOA2: 02/03/2018 (paper) ; 02/05/2018 (updated online) 

NVC RECEIVED: 02/15/2018 

NVC CASE # ASSIGNED: 02/20/2018

To my knowledge, there's no such thing. :( At least, my fiancé says so and he's the gadget/tech person, so I believe everything he says :P

 

The rule of thumb is 2 weeks after your NOA2 date, you can start calling the NVC. Either beneficiary or petitioner can call, to my understanding. I called (I'm the USC) in our case, and they asked for both our full names, the WAC number, and my fiancé's DOB. I chose the option for verifying receipt of case (I THINK it was Option 3), and I happened to call the day after they'd received our case, so he gave me our case number on the spot. Once you have the NVC case number, you can go ahead and start planning/booking medical requirements while you wait to receive further information. :)

Its TECHNICALLY a non-immigrant, but in actual fact, its non-immigrant with the intention of being immigrant...

Tell me, when you're married and adjusted status, are you planning to leave?  No.  You'll be an immigrant.

The actual visa is an immigrant visa, even though because of the 90 days, its regarded as non-immigrant because of the condition of marrying to gain status.

Anyway - the answer is yes :-)

I'm totally lost with all this now. So, he has to do the D-160 and gather all the stuff to send me so I can take it to the embassy..  Where can I find these phone numbers etc.? The immigrant/non immigrant confusion... 😳

Where do these packets come from? What are they? And where have all these other fees come from? There is no bloody way this i-129f lark should have been $500+

LOL you aren't the only one, don't apologize :)

 

So, the beneficiary completes the D-160. I want to say my fiancé did that after he received all his info post-NVC. But at this point, the petitioner can go ahead and collect all necessary info (financial docs, etc.) to provide the beneficiary.

 

The telephone number for NVC that I called is 1-603-334-0700. There's probably an international number, but I'm not positive of what that is. My fiancé found that number for me since I'm the American, and I called.

 

Our info came via email. It was sent to him, and I wound up being copied so I got a copy, too. It has all the instructions and info about scheduling an interview. We received it maybe a week after we got our case number. May not have even been that long.

 

Embrace the excitement! Take a deep breath and try not to raise your blood pressure :P You are arriving to the home stretch!!!!

Tell me, when you're married and adjusted status, are you planning to leave?  No.  You'll be an immigrant.

My understanding is that the K1 Visa is a non-Immigrant, however we all obviously have immigrant intent.

 

After we have entered the USA we can adjust our non immigrant status to that of an immigrant and get a Green-card. 

 

As such the petition that was filed on our behalf by our fiancé(e)'s was a non-immigrant one. An immigrant petition would be a CR1 for example.

I'm with vocaledge on this one.  The only reason it is non-immigrant is the 90 rule.  It become an immigrant visa as soon as you marry.  Say yes and explain the answer on the DS-160.  The K-1 is a non-immigrant visa that is treated as an immigrant visa.  I still say yes since, unless you are not going to get married (visa fraud) it is an immigrant visa.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Someone from a US gov perspective seriously needs to clarify this immigrant/non-immigrant issue. I've read older posts relating to the same question where everyone has answered "No" and all have been approved without issue - leads me to the question, does it really make a huge difference, they can see it's a K1 and there's obvious confusion surrounding it?

thank you all for your input... all of what you guys say makes sense... i am just wondering why they make it even more confusing than what it already is. I saved my DS-160 application for now and will continue tomorrow :)

I believe it falls into the category of the "Priority Date".  It isn't needed with the K-1.  I do not believe you will be penalized for either a "yes" or a "no" on that question.  The people reviewing it know what is going on.  It is not grounds for denial so if they are confused they will request a clarification.  I do not believe that either answer will surprise the CO.
