Just thought it was odd to ask for the beneficiaries details earlier in the document, and then again. That why I thought that section all related to if there was a previous petition.

I assume it's to differentiate between sponsors, co-sponsors, petitioners, etc...you think it'd be pretty intuitive, but I guess not!

So, My fiance has never filed for a tax return or done any taxes. 2017 was the first year that he has worked enough to file for a tax return. He has been working at a place A(the only place the govt knows about) since April of 2017. During the summer of 2017 he worked in two other places for which he can show 1099s.(he doesn’t work there anymore, only at a place A). Because he traveled some and worked a lot as an independent contractor/self employer he only made $12,000 last year as seen on his w2. This year he will be working full time at the place A, and he has gotten a good raise. He also teaches tennis lessons privately and takes in income from that, which can be seen on his bank statement. He can show his last two pay stubs and his letter from his employer, he just doesn't have any tax returns to show.

 

Will this affect his proof of income? What should we bring as evidence of income and financial security If we do not have any tax files to show? 

 

I appreciate greatly any help.

Also, mostly for anyone else wondering about this, the instructions say they only want tax returns if you have self employment income. Since your fiance has self employment income then he should include the return.

A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account: (1) Date account opened; (2) Total amount deposited for the past year; and (3) Present balance. B. Statement(s) from your employer on business stationery showing: (1) Date and nature of employment; (2) Salary paid; and (3) Whether the position is temporary or permanent. C. If self-employed: (1) Copy of last income tax return filed; or (2) Report of commercial rating concern. D. List containing serial numbers and denominations of bonds and name of record owner(s).

And for question 38. Does he mark “I intend to make specific contributions......” then in the additional information section put “n/a - K1 Visa applicatant” or do we need to write more than this. 

 

FOR question 38 this is how Rapid Visa does it.

 

For me page 4 of 8 question 38 I marked I intend to make etc. etc. Then on page 8 of 8 Part 7 question/blank space 3.d I wrote "I intend to provide room, board, clothing, money and all other needs for this person indefinitely."

 

I thought I better add this. If you do it like I did it, then also on page 8 of 8 Part 7 you will need to mark questions  3 a, b, c as the following  3a = 4, 3b = 3, 3c = 38 ( Basically you are telling them the additional info you are providing relates to this page, that part# and this question #. )

There are lots of NOA2s coming in mail without an update on case tracker.

Okay, so, we're having to use his mum as a co-sponsor due to some difficulties right now. 

 

Is there anything we should know or be aware of so we don't get the shock of it later? Just trying to prepare best we can so there is no further delay, and we can keep his mum in the loop as to what happens/is needed.

The 100% is for the K-1.  AOS requires the 125%.  It is a little confusing.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

I got the RFE today and they say we did not complete the portion of the application about past criminal convictions. I checked and we did. Now they want us to complete this portion and then have you sign it. Can you come in to do this?

 

They are RFE-ing us for something we had completed and a lawyer looked over too?

 

Should we be concerned? 

 

Lots of people have received RFEs for things they've already submitted, seems like a delay tactic or they're just really good at losing things. At least that's an easy thing to fill out and send back. :)
