Okay so I just got off the phone with the nvc , said they haven't received my case and it takes about 6weeks. This is 2 weeks since approval... calling them again next week 🤣🤣... after waiting 7 months for uscis, you bet I will not give them any breathing space

It certainly does feel like they're delaying timelines hoping that couples will break up. Joke's on them though, going out to Turkey again next Friday. Maybe we'll get approved during this trip, which was funnily enough what we thought when I was out there in December

We got our RFE letter today in the mail, but he's at work and we won't know what it is until later in the evening

 

Ugh.

 

Something as simple as checking the mailbox has become so suspenseful.

 

Praying for an easy RFE.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

called NVC yesterday. They received on 1/26

said we could have a case # as soon as today and latest 2/09. Sounds like they are giving themselves two weeks total from time received

Kinda confused.

I am wondering if someone can shed some light if it has happened before to anyone.

Our lawyer got mailed the RFE as well as us.

This is what he said:

 

Hi Blah blah.

 

I got the RFE today and they say we did not complete the portion of the application about past criminal convictions. I checked and we did. Now they want us to complete this portion and then have you sign it. Can you come in to do this?

 

They are RFE-ing us for something we had completed and a lawyer looked over too?

 

Should we be concerned?

So, My fiance has never filed for a tax return or done any taxes. 2017 was the first year that he has worked enough to file for a tax return. He has been working at a place A(the only place the govt knows about) since April of 2017. During the summer of 2017 he worked in two other places for which he can show 1099s.(he doesn’t work there anymore, only at a place A). Because he traveled some and worked a lot as an independent contractor/self employer he only made $12,000 last year as seen on his w2. This year he will be working full time at the place A, and he has gotten a good raise. He also teaches tennis lessons privately and takes in income from that, which can be seen on his bank statement. He can show his last two pay stubs and his letter from his employer, he just doesn't have any tax returns to show.

 

Will this affect his proof of income? What should we bring as evidence of income and financial security If we do not have any tax files to show? 

 

I appreciate greatly any help.

If he can show 1099s then the govt knows about those too.  Any time he gets a 1099 the IRS also gets a copy of it. He should probably have everything he needs to file now.  He should file 2017 taxes and use that including copies of the w2 and 1099s.  If he made income from teaching tennis he should be reporting that and paying taxes on it as well on the return.  I would include 2017 filing, copies of 1099s and w2, letter from employer, and check stubs if it was me.

Regarding Affidavit of support.

 

Part 3, 26a. Does anyone know if this question is in regards to an affidavit that may have filled out in the past? 

 

Part 3 question 26a: I have submitted a visa petition(s) to U.S. Citizenship and Immigration Services on behalf of the following persons. (If none, write "None" in the space for name below.) 

 

My fiancé doesn’t need to put my name here does he?

 

And for question 38. Does he mark “I intend to make specific contributions......” then in the additional information section put “n/a - K1 Visa applicatant” or do we need to write more than this.

Oh no, it was happening to us too, the stress and wanting to move to the next level.  We decided that we are going to enjoy our relationship as it is now and talk about or make plan for the future once this all gets done.  Trust me is has help so much because we are now living in the now and not the future.  I wish you the best.

26a. is where the petitioner writes the beneficiary's name.  So, if your fiance is your petitioner, then he'll write your name.  "None" is what a co-sponsor would write.

 

38. Yes, that's what you'll do.  Don't need anything more.
