Hello all and thank you ahead of time for any assistance you can offer 

 

 

I filed the packet for K1 for my fiance back in October and received notice back in November that it was received by CSC but I have two questions. 

 

First, My Fiance is a Venezuelan Citizen who is legally living and working in Brazil (Sao Paulo) for the last couple of years, with all proper paperwork. I noted that in the packet and that her nearest consulate was Sao Paulo. Will this be any issue that she is not currently residing in Venezuela or will she be required to travel home for any reason? We both for obvious political/economic/safety reasons would prefer her not to have to go back. 

 

Second. When I sent the packet in, I had a brain fart and saw on one page it required petitioners Birth certificate OR Passport with all pages whereas other pages I see that the Birth certificate is required. I only sent in fully completed passport. Do you think this will be an issue??

Answering in order you sent...

 

1- K1 visa applications are processed in Rio de Janeiro and eventhough she is in SP they will send her to Rio de Janeiro when the interview comes. I dont think it will be an issue.

 

2- As stated in Pag 10 (https://www.uscis.gov/sites/default/files/files/form/i-129finstr.pdf) they need ANY OF so I dont believe you will have issues.

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

For as long as she is a legal resident in Brazil, she will be able to interview there without a problem.

 

If you sent copies of all pages of your US Passport that will suffice as proof of citizenship. It's one or the other.

She will have to travel to Rio to do the interview? That seems odd considering there's a US consulate in Sao Paulo right? I'm not doubting you, I'm just wondering why make someone travel 12+ hours

@VZtoUS   Sure you can question what I said, now :D but remember, I`m from Brazil/SP,  did the all process that you only now is going through. Search a bit, read USCIS Web Site and you will see that I`m right.

Important: all immigrant visa interviews are conducted at the U.S. Consulate in Rio de Janeiro no matter what state the applicant lives in Brazil.

 

  • On the day of the interview, the beneficiary (applicant) must appear in person at the U.S. Consulate in Rio de Janeiro at the scheduled time. The petitioner’s presence at the interview is always encouraged. Attorneys may accompany their clients but they will not be allowed into the visa interview room.
