How to address Divorce, name change and Criminal History of petitioner for I-129F Petition

Hi all,

 

Almost finished with the process for creating the I-129F petition and getting close to sending off (Next Week)

 

Couple of quick fire questions on how to address some of the sections that the K-1 visa guide states on here that need to be addressed:

 

1- Name change: neither of us have had a name change. How do we address that or do we not even bring it up? Do we need to write a letter saying neither have had a name change at all?

 

2- Divorce: neither of us have been married or have kids. How do we address that or do we not even bring it up? Do we need to write a letter saying we are free to marry and have both never been married before or is that evidence the two letters of intent?

 

3- Criminal history: neither of us have any criminal history whatsoever. How do we address that or do we not even bring it up? Do we need to do a background check and send that off with the petition? 

 

4- Petitioner doesn't have personal cheques. Would a Cashiers check work just as well? 

 

5- We have color copies of the petitioners Birth Certificate. Is that enough to establish citizenship or do we need to do a full copy of passport and every page also? 

 

Sorry if these sound silly or basic. We don't know if we need to write a letter for each part or to just tick the boxes in the I-129F petition and leave it at that. Just want to be 100% accurate with our petition and give no excuses for a RFE

I have never done I-129F, however here is what I did for my Adjustment of Status/Green Card application.

1. I wrote NONE on Other Names Used field in the form, but you can always leave it blank.

2. By answering "No" on Item number 34 on page 6, you indicate the beneficiary has never been previously married. Similarly, by answering "Single" on Item number 23 on page 3, you indicate you have never been previously married. No other documentation needed if you both never been married before.

3. As long as you answer "No" to all items in Part 3 (Criminal Information), then you indicated you never have any criminal history. For beneficiary, you can include a police report to show beneficiary never have any criminal history.

 

4. Yes, Bank drafts, cashier's checks, certified checks, personal checks (See Check Instructions below), and money orders must be drawn on U.S. financial institutions and payable in U.S. funds.

5. We included a copy of the biographical/first page of petitioner's passport as well, but Birth Certificate should be sufficient.

 

To summarize, only if you answer "yes"/"Divorced" for the particular questions that you'll need to provide additional documentations.

In other words, just tick the boxes in the I-129F petition and leave it at that. Good Luck!

09/20/2018 Received text 'Interview was scheduled' and interview notice will be mailed

09/27/2018 Received Interview notice by mail

10/25/2018 Interview day

10/26/2018 I-485 case status updated to "We ordered your new card"

10/29/2018 Case Status updated to "We approved your Form I-485"

10/31/2018 Case Status updated to "We mailed your new card"

11/01/2018 My card was picked up by the USPS with tracking number assigned

11/05/2018 Green Card Received 

 

Side note: I turned my maiden name into second middle name. In the combo card, my given name is First Firstmiddleinitial, however on the back of the card, they attempted to list my second middle name.

I believe that if you look at the directions on the website for USCIS or wherever you get the form that you are filling out, it says what to do if the question doesn't apply to you.  I think it is put N/A or something.  I always buy money orders at the post office.  You can use your debit card to buy the money order.  I'm sure they don't want personal checks. 

 

If you are using the birth certificate for the petitioner to establish citizenship, it's cool to make a color photocopy.  I don't think it is necessary.  Rapid Visa insisted that I photocopy both sides of mine.  I think that they want both sides of most documents photocopied.  My birth certificate had some small nonsense stamp on it on the back, but if it will prevent an RFE, ok.  I sort of color photocopied everything.  I went to Staples. 

 

It sounds like the person above me gave good advice.

 

If you end up photocopying the petitioner's passport, color photocopy is a good idea.  I copied my ID page (as the above person suggested), and of course, any visas and stamps that showed visits to my fiancé's country.
