Eight years ago, I requested a K-1 Visa and was approved. I married that woman and we remained married for seven years. We divorced in the middle of last year. Since then, an aunt introduced me to a different woman whom I've discovered to be my true soul mate and love of my life. I proposed to her at the start of this year and want to marry before the end of the year. I've already started gathering documents and proof for the K-1 Visa, including my divorce decree. We've already met twice in person (I went once, then she came to visit me). I have tons of proof and photos of our relationship. We literally talk on the phone every single day for hours.

 

My question is, will I have any trouble getting the K-1 Visa approved since this will be the second one I request? Albeit, my first one was eight years ago, but I was just wondering if there is a limit or something. My fiancee is from the same country as my ex-wife (Nicaragua).

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It should not affect anything.  Marriages don't always last.  Eight years is a record these days (sadly).  And, it is very natural that you would end up with someone from the same country or culture as your previous wife.  Actually they had that situation before on 90 day fiancé.  (Not that those people are paragons of virtue!)  I hope that this marriage will be long and happy and you will be together by the end of the year like you would like to.  Best wishes!  :D

I don't see any issues that would arise. The most that could be asked is possibly the divorce papers but I doubt it. But it's good to have all of those things handy just in case you're asked.

I thought I was reading about myself when I read your story.  It’s so similar to mine.  I filed for a k1 for the second time in August and am currently waiting.  My first wife and I got our k1 and married in 2010.  We divorced in February 2017.  I met my fiancé after that and she truly is my soul mate.  I have also spent time with her on two trips to see her.  Going again next month for a third trip.  Both ex and fiancé from the same country as well (Thailand).

 

To answer your questions,  you can’t have more than one k1 within two years without a waiver.  We both are well outside of that.  And you are allowed to do two k1s total, but again you are even allowed to have waiver on that rule also.  The only thing to be concerned about is the affidavit of support you filed with your first wife.  That’s for ten years and you will have to do a second one on your fiancé.  You need to know if you earn enough to cover both.  I do and hopefully you do too.

Go for it. You were married for seven years and your ex went back; Thus, that marriage was entered in good faith, and like 70% of other marriages, ended in Divorce. You deserve to love and be loved and your K1 will be approved.
