Hmmm...puzzling my way through the I-864 right now, and I have a few questions someone might be able to advise on.

First, line 13 -- Place of Residence: as I am re-establishing domicile in the US, should I put my new address in America? This is the address on my bank account and where I have been registered to vote for the past 15 years (no surprise, it's my parents' address). Or should I put my address in London?

Line 15 -- Country of Domicile: I have been taking active steps to re-establish domicile in America, and have been following advice on the London Embassy website to do so (opening bank account, pursuing leads for a new job, telling my employer I a . However, I am definitely still here in London and won't be going back to America until Bruce gets his CR-1. Should I put down USA or UK? (I think it should be USA...)

Line 23 -- I assume I shouldn't enter my UK income here as it was all earned abroad, but does anyone have an opinion otherwise?

One other thing -- my mom has offered to act as a joint sponsor, which is fine, but my UK employer has now told me that they are likely to keep me on their payroll for a few more months after I leave in a consultant capacity. Would I be able to adduce this as US income and avoid having a co-sponsor? My boss said he'd be happy to write a letter to that effect.

I wish I'd xeroxed my I-864; as it is I don't have a copy of the one we turned in. :lol: :lol:

Line 13 sounds like they want your UK address. I'd put USA on line 15.

Your UK income doesn't count on line 23 normally. I have no idea what you'd do in your situation.

From my experience, the I-864 should be completed from a US-perspective. I used my US address.

Claim your domicile! Since London is OK with 'intent' to reestablish, and you've been banking and voting (and tax filing?) from the US, state US. If the officer at the interview disagrees, s/he can make corrections at that time.

There have been 2 schools of operation on this, especialy from London. You can't use your UK income as US unless it will be ongoing, but it sounds as if yours will be.. I would tend to write it in the best light for myself, and have evidence (as you describe). Again, corrections can be made on the fly.

You can always have a Joint Sponsor I-864 in your pocket, and if it looks like they are not going to accept yours on its own, whip out the Joint Sponsor's.

And take a tip.. photocopies of *everything* you submit! :)

What if I have not maintained a residence in the United States?

If you are acting as a joint sponsor you are required to show that you have maintained a residence in the United States. However, in cases where a sponsor may have abandoned his or her residence in the United States to live abroad, may have not resided there since a child, or in some cases, may never have resided there, he or she will not automatically be disqualified to act as a sponsor. In such cases, the question becomes do you intend to reestablish a residence in the United States. If this is indeed your intention and you can prove that you have or intend to re-establish U.S. residence, it may be possible for you to act as a sponsor.

You may meet this requirement by showing that you have taken or will take a credible combination of steps to make the U.S. your immediate principal place of residence. Such steps may include finding employment, locating a place to live, registering children in U.S. schools etc. In addition, you should make arrangements to abandon your residence in the United Kingdom; for example obtaining a valuation of your property from an estate agent.

Thanks everyone! I think I'm just going to go ahead with having my mom be a joint sponsor and not worry myself with the potential consultancy work. From all I've read over the months I know I shouldn't worry too much about the domicile issue, especially as I've always been registered to vote in Connecticut and continue to have some official stuff sent there.

Errr...just one more question. If we're moving in with my parents, are we or aren't we reckoned to be in their household size already? I read something somewhere that that would only apply if I'd been living there for 6 months previously, but this may just be conjecture. Any idea?

Your spouse is part of the household no matter where you live since your mom is a joint sponsor. You would only be a part of the household if you were a dependent of your mom's (which you're not) or if you were incuding your income as part of your mom's household income. :)
