My main reason I am worried is because he had overstayed his time on his F1 visa and that was from 2004

but his home was destroyed during a hurricane therefore he had no place to live if he went home so he stayed.

Me and my husband have been married for more than 2 years its not that we were lazy but we just had many misfortunes on our journey to file his paperwork. Well we were finally able to file it April 12 07 but i thin e forgot to send the I-130 form but however we spoke to a lawyer before filing and she told us the total price for filing would be 765$ me thinking that would be for I-131,I-485 and I-765. can somebody please let me Know if we should have sent the I130 or would we be able to send it anyway because we don't know what to do because we have yet to receive a response or receipt .

Usually they will mail you back all the forms you sent (ie: reject the AOS application), because there is no basis for your spouse to adjust status without the I-130 petition being filed. Do you know if your checks have been cashed yet?

As far as I know with a money order you have no way of knowing whether it has been cashed until you get the reciept from USCIS. People usually know when they are cashed and can find their reciept number on the backs of cheques they sent in and checking their online bank account. Good luck with everything,

Kristina
