Thank you. Some are Rapist, Some are murderers and some , I suppose are good people.

Yes, everything is possible.  I know a lot of good people that are legal immigrants, and there are stories where there are legal immigrants that are bad people.  Illegal aliens start out bad as they are breaking the rules initially.  I know, most people in the MDL don't care about the immigration rules, but rules are rules.

So open borders?  Or just more cyclical political hot potatos?

My other half of that post will

I think your auto pilot has been stuck on "open borders" for a long time and I see not one post from anyone here advocating for open borders. So please put the open borders followed by a question mark to rest.

You are telling someone it's okay to be an illegal alien for 2 years?

Boggles my mind in the context of the conversation in this thread. What's good for some eh?

4 hours ago, IDWAF said:

They are not illegal, they are "out of status".  Just means they can't work (No EAD even if they have a SSN), and leaving the country becomes more difficult (AP).  But when we did our K1, I knew of people doing it because of the cost savings.

Quite frankly, what you are pointing out someone can do is irresponsible. IMO it's kind of akin to an illegal alien adult bringing a baby into the country. They didn't enter the border over their own choosing but were allowed to be ''out of status'' per say. The terms of the agreement with the government is to get married within 90 days, remain and adjust or go home. Not remain and twiddle thumbs until you feel like it. Without having legal presence in this country, that spouse is subject to deportation and their entire future is in jeopardy. It remains the only way one can officially protect their K1-then spouse's status in the US, enables them to travel freely, and also enables them to obtain services they otherwise could not.

The entire ROC process is a joke, but I guess since so many folks scammed the system in the past, it is a necessary evil.

We're going to be going through it soon. Yes I too feel it's a joke. At this point I expect he can file for citizenship even before that finishes processing.

4 hours ago, NikLR said:

So the only illegals then are ones who entered without inspection? Is that what you are saying? Every person who has overstayed then isn't illegal, just out of status.   Like that is somehow different?  Still deportable.

The entire K1 needs an overhaul IMHO.  Bring someone here you only have to have prove that you have met once in the last two years?

But they dont really have any rights until the USC says so? Say hello to slavery.

How many threads are in the effects forum about staying with abusive spouses while waiting to adjust status?

I get why people choose the k1 and for some members here that I greatly respect it was the only viable option for them. Couldnt pay me enough to arrive in a new country without any rights though.

A VWP or visit visa holder enters with inspection. Hmm... if they overstay does that make them illegal? Or are certain members making mysterious exceptions now to the definition of illegal?

The K1 thing and meeting once is strange to me. Maybe me and him weren't typical... I'd lost count the number of times we'd seen each other by the time we filed, since we knew each other for over 10 years by that point. K1 was the only viable option for us, unless we did the naughty-naughty don't do it VWP thing, or married here and he went back home. And sure AOS was a lot of money... but so is the entire process? So is life. So is marriage. If you're serious about the commitment it takes, you do what you have to do to protect your spouse. We filed AOS immediately - there was no way I'd ever let my guy sit there not having some sort of protection to his status and not have rights in this country. We've all seen many a story on here, where the husband refuses to file the paperwork, effectively keeping the immigrant wife a prisoner in their home and vice versa. The fact that someone can simply choose not to file AOS (unless they can prove some hardship), is, without a doubt a 'loophole' I firmly believe should be closed. I'd like to see AOS + ROC be merged in some way for a K1. That may prove a challenge, considering a new couple may not be able to comingle funds in the way they demand to see for ROC purposes though.

I agree. It's insane that people only have to have met once. You can't figure out if you want to marry someone after only meeting once. And it's like the perfect way for human traffickers to bring people in.

I disagree. My wife and I knew each other over the internet for about a year before I flew over to meet her in person for a little over two weeks. While I was there we decided to get married and I flew back there a few months later for our wedding. We have been living together for a year now and have a 2 month old son together and couldn't be happier.

When you talk about meeting only once I'm not sure if you are talking about in person or if you would count talking over the internet and phone also. Some people might not understand it but I believe you can get to know someone well over the internet (of course you should meet in person at least once to confirm they are who you think they are). My friend met his wife who is from Canada over the internet and they got married after only meeting in person once. They have been married over 10 years and have 3 kids.

Hang around, I have seen many.

How am I supposed to determine what question you were answering when you use a one word answer?  I did read your post and the whole strengthening the border item you mentioned seemed like an afterthought after giving the DACA recipients a path to citizenship.  My argument along with many others is that if you don't strengthen the border first, you will just keep generating a new cycle that will have to be covered by a new or recycled solution.  To me that means people really don't care about border security.

because i'm the only person i've ever seen say anything about open borders (and not recently, or in this thread) outside of the constant accusations (ex "blah blah blah doesn't agree with the wall, hence they want open borders", "blah blah blah wants a permanent solution to daca and for daca recipients to be protected so they must therefore want open borders")

so who are you talking about?
