This won't happen in fact the Dems in CA are doubling down on helping illegals evade ICE even if their criminals. They are offering up a bill to punish those that help ICE. Also if you reaped some type of reward from the tax cut then CA state will take half of what you saved.

I heard about that. Any politician who gives aid to illegal aliens should be arrested.

Well, according to what I went thru, the visa should have counted for nothing.  It becomes null and void as soon as she hits the first port of embarkation in the US.  Then the I-94 takes over to provide legal status (90 days in our case).  But at least she got it done.  We had to wait for the GC because the DMV wouldn’t budge, they saw her as “out of status”, in spite of what the local USCIS officer told them.

Yeah, that’s pretty messed up.  Go take it elsewhere.  Then come back and bring your wife and stand in his line and tell him she passed.  What a jerk!

Expand

When my wife got her cr1 they weren't even issuing I94s which confused the DMV even more. CBP told me on the phone they stopped issuing I94s and my wife should use her visa to get a license. Her visa even said right on it that it serves as a temporary green card.

If you enjoy not having legal status.   Fwiw ROC cannot happen without LPR status so you would have to AOS, but after 2 years of marriage you dont have to ROC.

Yes, that’s what I said about the visa.  We WERE able to get her license when I showed them the NOA from the AOS process, even before we got the GC (remember that now that you jogged my memory).  But I told the lady at the DMV that she had no clue what she was doing when she refused to listen to the USCIS agent.  Very frustrating.  But overall, that was the worst part of our VJ, minus the waiting.

What are you talking about ? You can't skip AOS and go straight to ROC from a K1.
You can however skip ROC if you did AOS and have been  married 2 years or longer because then you will get a 10 year green card.

The DMV circus depends on each state's regulations.
They have written requirements from several categories. The requirements changed.
You choose whatever you have from the requirements and bring it in, if you don't have it then no permit/license.
K1 is used upon entry, so no good.
NOA1 from AOS some take it some don't.
EAD is accepted for most states.
Green cards for some states only.
It is easily checked online what each state requires now.

Well let’s hear your solution.  Mother steals bread and gets caught.  Mother is illegal alien, and child has no home to go to.  Illegal is handed over to CPS (of course the child wouldn’t go to jail, duh).  Now what?  What do you do with the illegal mother in jail and the illegal child eating up our tax dollars via CPS/HHS?

Expand

Since you asked, here is my answer.
Feed the mother, she is hungry.
I wouldn't put any mother in jail for stealing bread to keep from starving. I would cook her a meal and feed her and her child for as long as necessary
and help her to become self sufficient.

As to how would I handle DACA ?
Path to citizenship (same requirements of eligibility that have been in place already like age, how long here, military service etc.)
. Deport those who committed crimes. Tighten the border. Heavily fine employers who hire undocumented workers and fine the parents who brought the children here.
Then lock down the border but not with a tall shiny stupid wall that will not work. More border agents and go high tech instead.

AOS can't be skipped. You posted this before, and you eventually conceded that you misread something. If you adjust status after 2 years, you don't need to remove conditions.

Technically you are giving  incorrect immigration advice here. You really need to stop posting this.

Ok, let me say it better just so you won’t come on here and get upset.

MOST people doing the K1 thing file AOS shortly after marriage, then ROC a year later, and get their 10 year GC a year after that.  But if they elect to skip AOS filing right away, and wait until the 2-year point, they will skip the 2 yr GC, and save several hundred dollars. So yes, technically, they are filing AOS, but at the “normal” ROC point in the process.  And it’s not bad advice, people have done it for various reasons.  Hopefully this is clearer and appeases your desire for you to allow me to continue posting.
