I think that the clear correct choice is the honesty in showing her marriage, and "REALLY" that there is nothing wrong with calling USCIS with a question. The ANSWER to it may not be guaranteed, but there is a possibility that they could help.

Far more possibility of HURT than help, in my not so humble opinion.  You do show "marriages".  You do not show, non-marriages.  The relationship in question is not and never was a "marriage".

Could be.  If they are, then they need a divorce.  Is that the case here?  Not likely.  One key issue regarding "common law marriages" is that the only tend to be "recognized" when one party sues for divorce, based on common law marriage.  There's another RARE exception, but not applicable in less than a fraction of a percentage of such common law marriages for people over 70 or so.
