Tourist Visa For Birth of Baby

Hi all, 

 

I wanted to know has anyone experienced getting a tourist visa to come for the birth of their child. I am a U.S citizen and my fiancé lives in Nigeria. However I am 6 1/2 months pregnant with his child and I want him here for the baby shower and for the birth of our child in April. What is the likelihood he will get a tourist visa. What evidence should he bring to the interview?

What are your fiance's ties to Nigeria? Does he have a job? Property? Have you applied for a visa for him?

Looks like he has a lot more reason to stay in the US with a spouse and child than go back to Nigeria, so odds of getting a visa are low.

Yes he has a job, and he has properties. I applied for a K1 visa for him however if he gets approved for that he will miss the birth of our child. (Its looking like he will come in June if approved) I was told applying for a tourist visa while you already have a K1 visa pending will not affect the K1 process.

That is correct. It makes it extremely difficulty to be granted the tourist visa (especially from Nigeria), but does not hurt the K-1 case.

With A US fiance and a child about to be born in the US, and the K1 visa being filed which already shows immigrant intent, the CO may see him as having more ties to the USA than in Nigeria right now...all you can do is try, however, good luck!

I think you can still travel at 6 1/2 months.

Has he visited the US before as a tourist? If he has visited before then, he stands a better chance.

 

I applied for a renewal of my B1/B2 visa at the time my I-130 petition was in process with USCIS and it was approved. At this time (visa renewal application) I have investments in the US and my wife is a USC that lives in the US with our kids - in other words, I have more ties to the US than where was residing then and yet my tourist visa renewal was approved. I told the CO the truth, that I will be visiting my wife and kids, see to my business and that I have an I-130 petition pending.

 

I think the CO would consider that you would rather return to your country than overstay in the US to compromise your K1 visa application that is already in progress.

No I don't think its best for me to travel that far now especially since I'm so far a long in my pregnancy.

No he has not visited the US before but he has visited other places. Thank you for sharing our experience, what evidence did you bring to your renewal interview?

Just job letter and 6 months bank statements but the CO didn't ask to see any of the evidence I had with me during the interview.
