No CoSponsor....

Hello VisaJourney,

 

     My husband has one week until his interview. I feel so sad, because our lawyers associate did not notify us that my friend didn't qualify to be a CoSponsor. She barely told us this one week ago. 

 

     I have all my family, but they don't qualify due to dependants, don't make enough  (like myself), or don't have a birth certificate. 

 

     I have no one else to ask....

 

     I cannot believe this.... I only earn $11.00 p/h (16,000 on taxes), and I guess that doesn't cut it. 

 

     Are there any alternatives that I am not thinking of at all????

 

     Help, Please.

The lawyers associate informed me that a birth certificate is needed. 

 

And excuse for not be detailed.... I'm a bit on the down side right now. I haven't received my w-2 yet. But, last tax filing year I barely started my job, and that was only for four months. That's why I don't qualify.

1. The joint sponsor doesn’t specifically need a birth certificate- they need proof that they are a US citizen or legal permanent resident. So for a citizen, they can use a birth certificate, passport, certificate of citizenship  or a consular report of birth abroad. A permanent resident could use their green card.
2. You may qualify based on income if you’re making enough NOW. You can use current pay stubs to show that your income in 2018 will be sufficient. You don’t have to depend on last year’s income, since they do understand that people change jobs.

According to the instructions on the form, a joint sponsor can’t combine income with the petitioner - they have to make enough on their own.

 

However, this situation is another great example of a lawyer (who’s supposed to know all the rules) giving blatantly incorrect information. OP would have been better to do this herself! Now it’s almost the interview and the lawyer is not helping!

Yeup.

 

Too bad I didn't find this website until it was too late. 

 

All true about the lawyer. They always just told us to "wait", "call back in a month", and so on and so forth. 

 

But, I am here in this situation, and theres no turning back. 

 

So, I can combine with someone else? 

 

Now, that I have helpful people.

 

What's the process??

Everyone that I tried to call the consulate myself I was connected to a repeated voice machine telling me to choose numbers.

Maybe, a last minute change could help out our case.

Can I ask why your lawyer said your friend didn't qualify? As we've already proven, your lawyer has been wrong more than once.

 

Did you check to see whether your projected income for this coming year would qualify you to sponsor? If so then you need to provide your paystubs.

 

Or do any of your friends or family make enough money now that you know that they don't need a US birth certificate - only proof that they are legally present in the US? If so, then get them to fill the form in and send it along for the interview (ideally courier it so that they have the original at the interview.

 

Either way, if you don't have sufficient income on your sponsorship form, send it anyway... at the interview what should happen is that your husband should get a form (221g) that says they can't approve at this time because of the income on the sponsorship form. If he gets that form, all is not lost - you still have the opportunity to submit that extra sponsorship form - if you can find someone who qualifies, you can send in the form and they will approve his visa then.

My friend who voluntarily wanted to help made $39,400,And claimed 3 kids, plus her husband. 

 

Sorry, mentally frustrated, I left my job, due to how my boss was being; unprofessional. I only made 21,000. I received my w2 today.

Still pissed off that I believed we were set from what my lawyers associate had been telling us. 

 

How do you go and notify your costumer, like a week and a half, before the interview that we have no Joint Sponsor.

The level required for 6 people is a little over $41,000. So your lawyer is right, if a bit tardy with the information. It’s 6 as you need to count all those that the filer has as dependents plus your husband.
