Filing a k1 visa after annulment

Hi Everyone,

 

I am from the Philippines and I’m still waiting for the decision and eventually the finality for my annulment.

 

Can my fiancé start the i129 f process right now at least? Or should we wait until the annulment is final?

Nope. Both parties must be (and remain) free to marry from filing until entry on the K-1 visa. If the annulment is not final then you are not free to marry yet.

Note that an annulment in PI must also be registered before you are considered free to marry.

When we say “registered” that means the finality has been granted by the solicitor general right? Or is that a different thing altogether? 😊

The underlying requirement is that one must be free to marry. I believe that means the finality must be registered with the PSA, but the exact process is admittedly a bit over my head. Annulment in the Philippines is such a crazy (and long) process.
