Hello,

My husband file his I-751 in April of 2016 and his case went from Vermont service center to California service center. He has also done his bio metrics 2 month after filing.

On the processing times for California it says: August 31, 2016 - Does that mean they are processing for August as of now? Do they go one day at the time? In that case it will take FOREVER!!!

He is also eligible to file for citizenship in a couple of months, should we go ahead and apply? Even tho we haven't heard from the I-751?

Can he travel outside of the country while all these are happening? His green card is expired.

He is from Iran, so we are a bit hesitant since Trump can change his ban any time!

He is an LPR until the I-751 is denied (not saying it will be, just that that's the only thing that would make him go out of status at this point).

 

Yes, I-751 adjudication times are extremely backed up right now. He can file an N-400 seeking citizenship whenever he becomes eligible. It will eventually force USCIS to adjudicate the I-751 if it's still pending when it comes time to adjudicate the N-400. They may even be adjudicated on the same day at the same interview.

 

He can travel with the original (expired) green card and original extension letter. If the extension letter has expired (or will do so shortly) then he should obtain an I-551 passport stamp in order to be able to travel.

 

The Trump administration seems to have started to learn (very, very slowly) from their mistakes, and exempt LPRs from their 'travel bans' now.

Yes. You make an Infopass appointment at your local office. Take your valid foreign passport and the original I-751 NoA showing it's still pending. 

 

There usually needs to be under 30 days of validity remaining on the extension letter before they will give you a passport stamp.

Im a bit confused about when you filed, was that April 2016 or April 2017.  Says you weren't interviewed until Feb 2015 on your timeline.  So if that was the case you were due to remove conditions around Oct 2016, 90 days before.  if you filed in April 2017 and it was California you have a long wait, if however you filed in April 2016 then you can do a service request as they are dealing with cases in August 2016 which is quite a while after April 2016.

Oh, I see. You are right Shell. I was wondering April-2016 is a long time and there will be hardly any applicant left without being adjudicated. Thanks for pointing it out.
