My wife (the petitioner) has used her maiden name on all the paperwork as she has yet to legally change it. We noted this in the cover letter saying we "were recently married, yadda yadda yadda..."

There is no problem in this as far as I can see, but the USCIS isn't going to be weird about this in anyway, are they? 

OR should she have used her married name throughout the filing ?

 

Small concern but thought I'd ask

I should say that her name is changed on the marriage cert but everything else is maiden. Just to clarify.

1 you get married

2 you file your paperwork with your married name 

3 you write down prior names used (maiden name on the paperwork)

4 your backup will be in the maiden name of course because the passport and visa can only legitamely be in the maiden name 

5 you attach a marriage certificate to every form you are filing not just the and but all i765 i131 etc 

 

I never understood what people were saying when they said change their name on the marriage certificate ? 

Isn't it her maiden name on he marriage certificate?

I have my maiden name and my husband's name on our marriage cert. Apparently you are suppose to have your maiden name on marriage certificates otherwise when it comes time to get Insurances etc people have had issues showing they weren't related  ..so I'm just curious what you mean by this?  Come to think of it this must vary greatly state by state
