Active duty service member- new naturalization regulation

My husband and I are in a difficult situation with the military and the naturalization process.

 

He enlisted February 2017 and was promised citizenship after basic training. He was supposed to receive it in October but his command wouldn't allow him to travel to Houston for the ceremony and they made him transfer it to our current duty station. Since then, the government has changed regulations which requires an O-6 or above to sign his N-426 form and more department defense checks.

 

His command is making it impossible to get the form signed. We are trying everything but they won't send it up the chain of command. This has been happening for a month now.

 

I'm worried because during this time period his conditional green card expired so now we are left without a green card or citizenship. Before it expired I contacted USCIS and they said we didn't need to renew because he had a "change in status". I'm regretting this decision and I don't know what to do?!?!

 

Please help! Can we try to get a green card now just to feel secure or is there anything we can do?

 

We can't be the only family in this nightmare.

Normally, I wouldn't recommend this but this sentence gives me reason "His command is making it impossible to get the form signed. We are trying everything but they won't send it up the chain of command."  I don't know the whole story obviously, but I'd go make an inquiry at the IG office (you do NOT need chain of command permission to go to the IG) and let them hash it out following an investigation as to why your CoC is holding you up (Be prepared for the other side of the story; however, if there is one...)

From K1 submission to US Citizenship- 2 years, 1 month and 2 days!

K-1 Process
• 6 MAR 2012 - I-129F packet sent via FedEx overnight •

• 7 MAR 2012 - Packet received Dallas, Texas
• 12 MAR 2012 - NOA1 (Notice by Email: routed to the CSC)
• 15 MAR 2012 - NOA1 (received Official Receipt Notice (Form I-797))
• 12 JUN 2012 - NOA2 (Notice by text message and Email)
• 23 MAR 2012 - NVC received/forwarded approved I-129F
• 25 April 2012 - Interview and Visa Approved!
• 27 APR 2012 - Collected Visa at Embassy
• 29 MAY 2012 - Arrival in US after two weeks holiday together!
*It took 46 days from NOA1 to Visa pick-up and we received our NOA2 two weeks AFTER her arrival in States!

AOS Process
• 13 JUL 2012 - I-485 packet received at USCIS
• 23 JUL 2012 - NOA I-797C received for I-485 and I-765 (we didn't do an AP)
• 10 AUG 2012 - RFE for Proof of Employment and Fed. Poverty Level/Support Requirement!(Active Duty Military but deployed last year with little taxable income to report)

• 16 AUG 2012 - USCIS received my RFE document response & Biometrics completed on same day
• 21 SEP 2012 - EAD Received after a total of 6 USCIS Status updates

• 26 MAR 2013 - Email Notice that AP was approved
• 03 APR 2013 - Card in hand! (9+ months from application to receipt of card)

• 20 JAN 2014 - Packet mailed

• 02 FEB 2014 - walk-in Bio appointment

• 24 MAR 2014 - Interview

How is he as a soldier overall? I can see them doing this if he isn't a good soldier. Sorry just asking.

Update on the situation:  After 2 months we got the form signed because his SSG had connections. For some reason his brigade wouldn't send it up the chain of command and we found out that there are other soldiers trying to go through the same process. They are having the same issues because the brigade doesn't recognize that the laws have changed I guess.

In the original post, I was kinda freaking out cause my husband thought his green card was expired but he was mistaken. When I actually looked at it, I couldn't believe it.

 

Now we are waiting for the next hoop we have to jump. The form was sent to Washington to get approved and we aren't sure what will happen next...
