Filing form I-130 for spouse and daughter

Hello,

 

I am a permanent resident and getting ready for file I-130 for my spouse and daughter. I filled out the I-130 and I-130A for my spouse and I-130 for my daughter. I had a question on supporting documents. Apart from Marriage certificate and my daughter's birth certificate, what other supporting documents can I send?

 

Also on form I-130 part 4 (Information about Beneficiary) its asking the last address at which you physically lived together. My spouse is abroad. So do I put "Never lived together" on that part?

Thank you for your assistance! I did go through the guides that you posted. I guess there is a slight difference in applying for Spouse and Child for Permanent resident and USC depending on if the beneficiary is already in US or abroad.

 

In my case both my beneficiaries(My Spouse and daughter) are abroad. I had a few questions:

1. Reading through the I-130 Instructions, I got the impression that I need to file separate I-130 petition for both ( 1 for my spouse and 1 for my daughter). The derivative beneficiary situation doesn't apply in this case does it?

 

2. How do I show the evidence(s) of bonafide marriage? Back in home country, my spouse and my child live with my parents. There is no joint property ownership or such. That's just our culture back home. I do, however, send financial support to her bank account every couple months or so. Please suggest what would be the best way to address this.

 

3. The passport style photos, I read on the I-130 instructions that it isn't needed if the beneficiary is abroad. Please correct me if I am wrong.

Ans: Wedding Pictures, any other pictures together,money receipt, Marriage certificate,Chat logs, etc should work too

Ans: This part is bit confusing on I-130 instruction but i do remember sending them two copies of identical pictures of Petitioner and beneficiary

Why can't the child be included as a derivative beneficiary? F2A permits this.

The only concern is if the petitioner naturalizes...thus upgrading the petition to a CR-1/IR-1, which does not permit derivatives. This is entirely in the petitioner's hands, though.

you are right. I have mixed up F2A with IR1. Thanks for the correction

i just filed i130 for my spouse and 2 kids last december and i already received my priority date. I only sent 1 i130 since both kids will become derivatives for my wife. Documents we sent were mc,bc for all of us,passport pic of me and my wife, and remittances i sent ehich is every month thru remitly.

I am planning on filing Naturalization application soon as well. My window opens by the end of this month. But also wanted to get the 1-130 petition going for my wife and child. So maybe separate I-130 is a better idea to stay on the safe side.

If you believe you will naturalize before they enter on the visas, then yes....petitioning for each individual should be done instead.

Hello. Did you mail a separate payment for your spouse and daughter? Or just one money order.

The address to file I-130 when the beneficiary is abroad is the Chicago location, isn't it? Just want to confirm

I was told by a lawyer that you only send one money order for the wife and not for the kids. That's why I am so confused.
