Bringing my wifes daughter to the USA

Hi all,

 

My wife and I moved to the US October 2016, my wife has her first green card.  She has a 13 year old daughter from a previous marriage that did not come with us, her daughter is in the custody of her ex husband.  Recently her ex husband has been having a lot of trouble, and now wants their daughter to come to the US and live with us.  This is a bit of a surprise to us, so I suspect he has some big legal troubles, but that is beside the point.  I have read the guide stickied to this page, and can't determine what applies to us.  Can we add her daughter on to her forms even though they were processed over a year ago, so do we need to do a new petition (I think this)?  I have read we will need her ex husband to sign a form releasing their daughter to come live in the US with us.  I want to do that form first, because I expect him to go back on his word to let her come here.  Does a standard form exist for that?

No, time for follow to join (if wife came on k-1) has passed. 

 

You as the USC stepfather can file I-130 now. It will take around a year until visa in hand so better find a family member to take in the child until then.

Thank you!  That is what I thought we would have to do, and I figured about a year. 

 

Do you know of a standard "permission" form that her ex husband would need to sign in order for her daughter to get a visa?  I know she needs to have him sign off, but I don't know if their is a standard form.
