Our American citizen friend recently married his Filipino fiance. She entered the U.S in October 2017 and they were married in December 2017. They were recently turned away at the SSA when filing for a SSN. The SSA employee told them that they must complete their AOS process and have a green card in hand before applying (Indiana). I have read conflicting reports that some states will only process a new SSN for a non-immigrant (i.e. K1) if their I-94 is within fourteen days or more of expiring. Can anybody confirm without doubt that this is true?

MEETING

12 March 2012: Met Dyn at a coffee shop in Kuwait

Summer 2012: I returned home to the U.S. to prepare a way for Dyn

Fall 2014: Dyn returns home to Philippines after seven years in Kuwait

ANNULMENT

February 2014: Engaged while I visited Philippines

March 2014: Officially hired attorney and filed for Dyn's annulment in Bohol, Philippines

December 2015: Bohol District Court issues decision in our favor

December 2015: Judge sends transcript of his decision to OSG for processing

February 05 2016: OSG returned receipt and approval to district court in Bohol. CoF to be issued end of second week in February

February 09 2016: Dyn is presented with the Entry of Judgment and her Certificate of Finality via the local court.

February 15 2016: LCR issues annotated marriage certificate, and necessary documents are forwarded to the NSO / PSA visa LBC

April 19 2016: Received CENOMAR and Annotated MC from PSA via private courier. DONE! COMPLETE! FINISHED! OFFICIAL!

I-129F / K1 VISA APPLICATION PROCESS

April 04 2016: I-129F sent to Texas Lockbox via USPS Priority Mail

April 12 2016: Email from USCIS acceptance confirmation

April 17 2016: Official NOA1 hard copy received

July 12 2016: NOA2 Approval hard copy received

July 14 2016: Post Decision Activity email from USCIS

THE LONG WAIT (USCIS misplaced approved petition)

September 16 2016: NVC received approved I-129F petition and assigns case number

INTERVIEW / MEDICAL PROCESS

October 04 2016: Day 1 of medical at SLEC in Manila

October 05 2016: Psychiatric evaluation off-site due to psychological incapacity annulment (10 hour eval with 800 question profile test)

October 13 2016: CFO Seminar completed successfully and certificate awarded (CFO stamp not issued until visa is presented).

October 20 2016: Return to SLEC complete psychological evaluation with resident psychologist (less than ten minutes)

October 21 2016: Vaccination day at SLEC (medical finally complete)

October 25 2016: Visa interview at USEM in Manila (APPROVED)

HOMECOMING

November 19 2016: Dyn's arrival at POE Dulles IAD in Washington DC

December 01 2016: Married

When does their 90 days expire, and is it already expired?

 

Different states have nothing to do in getting a ssn because it's a federal matter. This happens occasionally because someone doesn't know the details. Just tell them to go to another ssa office and they should get it done. If the 90 days has passed then no they can't get it until aos

go to a different office or back and ask for supervisor

 

take marriage certificate and her birth certificate and proof of address like a utiiily bill or mail with her name

we went with his passport and IR1 stamp the clerk said to bring our marriage 

we went back the next day and a different clerk said ""all i need is the IR 1 visa stamp,  immigraiton has already seen everything else"

A person who enters the US with a K-1 and still has an unexpired I-94 can apply for a SSN once he/she can be found on the SAVE system. However, not all SSA employees are aware that K-1 holders are indeed eligible for a SSN. She can either go back to the same office and speak to a different officer OR she can visit a different SSA office hoping that the officers there would know better. Here in Atlanta, the Marietta office that I went to and the multiple officers that I have spoken to or dealt with, all know that K-1 holders can apply and get a SSN. I was issued one just fine (they even sent me 2 cards for the same number :jest:) and I haven't even filed my AOS. Here's the thing though, the new I-765 covers SSN application so just do it through there and she won't even need to go to SSA.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Exactly, it's most likely too late now, they waited way too long.

 

They should've applied as soon as the i-94 was available (which is usually the same day or day after you enter the US), or the first couple of weeks after entry at least, before the wedding. Now they need to wait for the EAD (4-6 months wait time from NOA1) or greencard (anywhere between 3 and 18 months). This will make it harder when they file taxes etc in April, they might need the SSN for other things too. 

 

So to other K-1ers, don't wait. Get it done asap.

It's "with more than 14 days of validity", not "within 14 days of expiring". Or you can use the EAD, or a green card.

Actually CR1 and IR1 can check the box on the form submitted to NVC that allows the government to file for SS number with the packet turned in at POE

only K1 personal need to apply for themselves
