back in febuary we hired a lawyer in hcmc to look at our case and see why we was denied. he saw my fiancee had divorced so close to the time i went to vietnam. she had been seperated for nearly two years so he had her get all her adresses where she lived and her exs family book to show when she left and a police report when she left home town. the next week he was going to talk to the head cheif but he canceled . so then we had to wait till mid march cozhead cheif was i the states . then he was coming back and would have meeting 3rd week march but he didnt then the fourth week but he didnt.then he did come back but my lawyer decided not to see him andf just turned our evidence in at the window like every one else but he said he didnt talk to a co it wasd a OVER COME DAY ,he noticed we was in f p u , two things wrong with fraud prevention unit 1 they take forever and 2 the vietnamese investigaters just makes stuff up some times. best thing to do is come on down to vietnam and get a pfu interview. great!!! i got my tickit and i leave march 4 . but very other day he going talk to head cheif but always cancelled or head cheif got pulled away before our case was brought up.long story short he talked to head cheif today and he no longer inquires about pfu cases or make any pfu apointments . so i will go to vietnam for one week to see my girl with the week i had saved for almost a year so we can marry when she comes and we wil be sad. im calling congress but i doubt they really give a #######. so if ur case is in fpu your screwed. good luck to everyone

Green/Tran,

I am having difficulty understanding your post. I know you are upset and dissapointed but please, be in your stable state of mind when you post something. That way, we can all understand and may be, offer advices. So, what are you saying? Is your case still with the Fraud Prevention Unit or is it not? Back then, my case was put under AR for nearly 10 months and I almost lost my mind. However, I was able to convince the people at my congresional office and as soon as they intervened, my wife was able to secure her visa within a month. One thing I know for sure that if, indeed, your case is being investigated by the FPU, any inquiries from your Congressman or Senator will be denied and they will be informed to hands off your case. In your case, I'd say you really have to press your lawyer to fight for you. He was right about the 2 things with FPU. This not the time to loose your concentration. Good luck

I used to be indecisive. Now I am just not sure ...

You should list your timeline in details for let us understand about your case, so we can share you some experiences if we could.

I think now is the time for you to ask help from the congressman. But you should say clearly about your story, I could not understand your story. The staff and CO usually work under high pressure of daily interview, therefore they will base on the standard points to approve for our visa or not. I can tell you some simple points such as:

- The first time you met each other, who introduced you or you knew each other by yourself?? Any case with introdution from Vietnamese relatives will be in trouble.

- The divorced time, if the divorced time was after the date you met each other, your case may be delayed.

- The times you come to VN to see her and live with her. It should be more than 2 trips to Vietnam and the time should be more than 1 week per time.

- You never sponsored for any other wife to come to USA yet, if yes, you must look for some more evidence from this wife. Otherwise, it may be delayed.

- Your relationship must be kept in contact continuously at least 6 months before you apply petition. This point, they list very clear in packet 3.

- Your legal background, there is no record for any violence to the ex-wife or children or no record for fraud marriage affair. It's listed very clear in the very first period you apply for petition, they required you to sign to be responsible for this point. If they found out you had any record, your case will be delayed or denied as the paper listed.

.........

The above is only some points that I remember now. If you are in these cases, you should think how to explain and prove your relationship.

Good luck, Green/Tran. Try to keep calm to solve your problem.

Your post is hard to understand, but I got divorced December 19th 2006, remarried January 25th 2007 and our petition was still approved. I do not think it is uncommon to be separated without the headache of actual divorce. I was separated from my first husband, but had to get the divorce in order to remarry and that was why mine was cut so close, but nevertheless I am sure that couldn't have been the issue with the USCIS for denying your petition. You can contact the USCIS yourself with you case number and inquire as to why they actually denied your case.
