I am not entirely sure what you are meaning by being a resident. K1 Visa holders are stuck in limbo because they cannot work for a period of time until they get their EAD. My husband could not get his state driver's license until he got his EAD.  His EAD took 87 days which was over 60.

There's no guarantee that immigrants on K1 can drive legally - rules to get a license do not necessarily align with the immigration process.

I agree, that is why I was responding to the post that said 60 days, you must do this when it may not be possible because of immigration.

I also needed EAD before I could get my DL.

What papers you need to apply for DL depends on the state.  Indiana BMV sent a 'Real ID Checklist' with the email ( already listed above but I'll repost https://www.in.gov/bmv/files/BMV_Documentation_List.pdf). In it it lists what original document you can use to establish lawful status. Among them an 'I-797 Notice of Action received by DHS and accompanied by other U.S. Citizenship and Immigration Services (USCIS) documents.'

I don't have my AOS papers filed yet of course but I'm pretty sure that you will get some form of I-797 NOA for your AOS or your EAD application. In combination with the NOA-2 + K1 visa stamp that should provide enough proof in my opinion?

It also lists an 'unexpired foreign passport ... with an unexpired Visa and approved I-94'. But I assume my K1 becomes invalid at POE, right?
