Annulment

Hope that you don't need annulment. It is a horrible process. My fiancee started her's in August of 2014. It took until March 27th, 2017 to get through the courts with a decision in her favor. Yet it doesn't end there. Then you get to deal with some of the worst people on the planet, the PSA, formerly known as the NSO. I have seriously never met a collective group of people who are as lazy and incompetent as the PSA. Imagine being told in August of 2017 your documents would be ready only to call the day of release and be told there was an error. Then the same thing happens in September, October, twice in December, and twice in January of 2018. All along the way being told by the PSA how grateful you should be to them for making things "fast."  Not once has anyone made an apology for their mistakes. In fact, I was actually told by a lady at the PSA that she would no longer answer me after I pointed out the utter lack of logic behind what the PSA is doing. We discovered last week that the department that handles this has many stations set up for reviewing the documents. We were told that each time our documents passed one station another station would find an error. That is why they are only finding one error at a time. Once one error is found, they stop the review and send it back without reviewing the rest of the documents. Think about how ridiculous that is. Anyway, each time it goes back to the PSA, it has to go through every station again. They do not send it directly to the station which claimed the latest mistake. So every time you send back expect another month or more processing time. My favorite part is when I call and they straight lie to me, get caught in their lie, and then play dumb. Meanwhile you hear their co-workers laughing and joking the background rather than you know, working.

The final court decision was made on 27 March, 2017. It  is now Jan 15, 2018 and we are still waiting on the finalization of the annulment from the PSA. Not one time did we make a mistake on our end. Every mistake has been the local registry or the PSA.

Much like the Bureau of Immigration .... they spend more time ordering "delivery" and standing around chatting then working.      I have been there waiting for the doors to open, shortly after the doors open the delivery boys start arriving  ..   good grief.

Annulment doesn't need to apply here.  it can be 2-5 years and extremely costly, but with the details given by the OP, it's not necessary.

As Hank said, Recognition of Divorce is the appropriate step IF the OP wants to marry in the Philippines.  It will need to be filed with the assistance of an attorney in the Philippines and would likely take around and year and cost 80,000 to 150,000, depending on the attorney.  If OP marries anywhere else it's not necessary.

The Philippines is one of only two countries in the world that doesn't generally recognize divorces (a few cases aside).  The other is Vatican City.

Dang! Who would spend those kind of G'S just for annulment.  never thought of it bummer!

That is why so many just walk away from a bad marriage and start a new relationship ... annulment is impossible for the average person.

My friend met with a friend of the family who is a judge.  She has a lawyer now who is charging her 250,000 php for the lawyers fee and she will end up spending another 30,000 to 50,000 for "gifts" to various people.  She will end up at 300,000 php and there is no telling when this will be over.  She has witnesses to her ex-husband's abuse and he was arrested 3 times.  We still believe it will be 2 to 3 years before the annulment is granted.

Here is the short answer. Yes you can remarry but under certain circumstances based on the following.

1. If you both are Filipino citizens then you will need to complete an annulment from the Philippines.

2. If you are Filipino and your x-husband is a USC and you divorced him then you need to complete an annulment from the Philippines.

3. If you are Filipino and your x-husband is a USC and HE filed the divorce then you need to register the divorce in the Philippines and you will be free to remarry.

4. If you want to remarry, do it in the US or some other country but not in the Philippines that way you bypass the Philippine Government BS.

US does not report marriages or divorces to foreign Governments.  For your own good and in the event you need documentation, get a copy of the divorce decree. It can be secyred from the county in which the divorce took place in TX.

Good luck.

I have a similar dilemma in another thread .. quick breakdown, Filpina fiance working in Hong Kong, had annulment in PH in 2015, but not completely registered in Manila. I can go to HK and marry her there?!?!

If the certificate of finality has not been issued and registered with PSA the annulment is not finalized, meaning she is still married.   The embassy will required a CENOMAR for the visa process, if PSA does not have record of the annulment being finalized they will issue an Advisory of Marriage (commonly referred to as a CEMAR), without "notation" stating she is married.

If you marry before the annulment is finalized .. well you know what that is called...  and nothing good can come of that.
