CR1 Filing Timeline in USA

Hi ladies and gentlemen,

 

I recently proposed to my British girlfriend while she was visiting me in Chicago over Christmas.  We have decided to get married next week and apply for her CR-1. She will not be returning to the UK and we will file all the relevant documents for her from Chicago. My question is if we plan a big family wedding in the UK for later in the year we are  thinking July/August  will this give us enough time for all the paperwork to be done and allow us to travel together to the UK. Would 6 - 8 months be a sufficient length of time to allow for the process? Has anyone been in the same situation and would like to share their experience or timeline?

If she is not returning to the UK after marrying you, then she would adjust status here.  She would not file for CR-1.

Is she in the US now?  If she is here, then yes.

Yes Sir, she is still here with me now. We are waiting on her birth certificate to arrive in the mail

Then after you marry, she can adjust status.  She can not leave the US or work in the US until she has an approved Advance Parole and EAD documents/card.  That takes about 4 months after filing the paperwork with the AOS.  If she leaves the US prior to having approved advance parole, she will have abandoned her status. 

You can also expect the process of receiving her green card to be about a year after filing AOS.

 

However, she can marry you, return to the UK, and you can file paperwork for her CR-1 This process takes 12-14 months.  When she enters the US, she would be able to immediately travel outside the country and work.  Visits to the US while processing are allowed.
