I petitioned my husband as a US citizen. I got my passport with my birth certificate (from a widwife) and had to provide evidence of my mother's presence in the US at the time of my birth because they didn't believe my birth certificate was legitimate. I provided extensive evidence of my life here in the US, baptism, immunizations, and school records to the US Dept of State, then they approved my passport. Now the US  embassy in Juarez, MX is doing the same thing. They placed my husbands visa in AP to further investigate my birth certificate. They said they will be contacting the US Dept of state. Do you think this will suffice for them to approve his visa? I'm so sad and devastated. We don't know how long my husband will have to wait in Mexico.

I can certainly understand why it would be investigated again.  Births using midwives frequently occur at hospitals or birthing centers. Yours apparently was at home or not in a recognized facility. In their view, of your presence in the US could have occurred after an illegal entry especially if your mother was not a citizen or legal resident at the time of your birth. Evidence of your presence in the US is not evidence of your mother's presence on your birth day.

 

It is especially suspicious since you married a foreign national after having claimed to reside in the US.  Unless you were spending a lot of time in Mexico or he was in the US, your marriage is improbable.

I'm going exactly through the same thing, I was born with midwife in South Texas, my husband has been held in AP since October, I obtained my passport without a problem. I'm working on submitting information to CD Juarez consulate regarding my birth. It has been a very difficult for me to keep our family afloat while he's out there, he has not been in his country in over 20 years and obviously being separate has taken a toll on my family but I'm confident and keep faith that things will fall into their place and my husband will soon be back home. Unfortunately I feel that I've fallen into a situation where state laws are infringing with Federal requests, I've gone to the state to try to obtain my original birth certificate, mine in particular was amended when my father was added and Texas state indicates that when my birth certificate was amended, the original information listed on the birth certificate (signature from the midwife) was removed and further more vital statistics went as far as removing the original record from the local registrars office and as far as I understand state too, I've gone to Austin physically and have been told information cannot be added. I've submitted all information needed, per department of state  I have a valid birth certificate, or I would not have been issued a passport, I understand that it's their job to do a thorough investigation. Have faith and be patient that things will fall into place.

In AP since October?!! Omg, this is going to be really hard. I submitted a copy of the visa my mom used to enter the country not long before my birth to the State Dept. and they were able to give me my passport for that reason. That proves she was present in the US at the time of my birth. Will this be sufficient for the US Consulate? The consulate said they will be contacting the State Dept. I wonder if this will help speed up the process. They're not questioning my marriage because my husband and I met here in Dallas TX, got married, and have two boys together. The problem is my birth certificate.
