i-751 backlog 2017

My wife filed for her I-751 back in September of 2016. She received a receipted and did her bio-metrics. We waited about a year and called the immigration office. USCIS said that there was a backlog with i-751 processing time and to wait another year. In the mean time, she got a stamp on her passport authorization her to travel and work in the US. Later, my wife receives a letter for USCIS stating "Your petition is still pending consideration. We regret that we are not able to give you a timeframe for when we will complete the review of your petition"  

 

Moving forward, it is now January of 2018. I'm checking my wife's status online and the message has not changed. has not changed from the original. "On September 12, 2016, we received your Form CRI-89, Petition to Remove Conditions of Permanent Resident Status Received, Receipt Number WAC*************, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by October 12, 2016, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

 

At this point, i'm kind of worried that they might of lost her application. Anyone in the same situation?

Online status for I-751 does not change until card production , and there is indeed a massive backlog.

 

Request congress person / senator assistance , or file the N-400 as you are now eligible to do so.

Can my wife still get her citizenship even though her i-751 status is still pending?

Your wife can file for her citizenship with the pending I-751, however; the N 400 will only be adjudicated once the I-751 conditions are lifted. This can happen before the N 400 gets adjudicated or during the N 400 interview where a combo I-751/N 400 interview is conducted. The later seems to be the norm nowadays for so many people whose end goal is getting their U.S citizenship anyway with the dangerous backlog. Word! There’s a high chance though that once the N 400 application is filed, this will cause the I-751 petition to get requested to be transferred to the local USCIS field office where it will now be a joint petition to be adjudicated together with the N 400. This shouldn’t be a big deal if N 400 is end goal as mentioned, the only set back is she won’t get her 10 year green card when her service center starts adjudicating petitions during her priority date. She’ll have to use stamps until she gets her citizenship.

Based on the USCIS website and applicants experience on visajourney you may hear a response within  60 days. For those who applied the i-751application to California the estimated time  to hear a response/decision is 1 year and 4-6 months. So in other words you applied in September 2016 that means you should receive a decision in January 2018 or February 2018. 

 

Those who applied the I-751 application to Vermont their estimated time to receive a decision is 11-12 months.

 

As mentioned above your window is open now to apply for n400 if you have been married to a U.S citizen for more than three years. Many of the applicants applied to n-400 while their i-751 is still pending, and they became U.S Citizen and never received the 10 year green card.

Some do not recommend to apply to n-400 while your i-751 is still pending, however legally it is your right to apply when your window is open to apply for n-400 while your i-751 is till pending.
