Hi,

 

My sister who is a US citizen filed a petition for me and my family (including who now is my exwife) 7 years ago. During the process, I have divorced my kids mother and also met online a beautiful woman who is a US citizen. We started a beautiful relationship and I will be proposing on April when she comes to visit me for the first time. My girlfriend wants to start a K1 process for me so that we can get married in the US.

I would like to know if the new process will automatically override the previous one initiated by my sister or does my sister has to request to cancel it? Also, is there a time line suggested for a fiance to start a K1 process or could she just file it as soon as she is back after her vacations on April?

My 3 kids will remain with their mother for a few years before I petition for them, is that ok or should it be done right away?

She can file as soon as she has all of the evidence of your relationship. Also, since you are divorced you will need to provide the court documents of the divorce.

 

The process for K1 is taking anywhere from 9 months to over a year.

 

Filing later for your kids is fine also.

 

Note: Your exwife should be adviced that since you two are divorced, she will not be able to come to the US under your sister’s petition.

So this is somebody you have yet to meet?

 

Probably best to do that first.

Best to concentrate on meeting her first.

There's no reason to cancel it.

 

Meeting and taking care of the relationship would (unassumingly) be the priority, though. Proposing on the first meeting and/or a quick I-129F filing can be viewed negatively with some embassies.
