Resubmitting of forms due to I-797c

Hi.  I had some quick questions about a rejection notice.  It was rejected for incorrect fees, but on the I-485 I have the correct amount on the check for 1225.  Was it rejected because I did not have the entire "Department of Homeland Security, Citizenship and Immigration Services,"  or maybe that I didn't have "and biometric services" along with what the check is for?

 

Also, can I resend the same package that I was sent back from USCIS? They reorganized and stapled things together.  Is it okay to resend the forms like that or would I have to reprint everything from scratch?

The filing fee is $1,225 and the instructions clearly state that cheques should be made payable to "U.S. Department of Homeland Security".

 

You can just use the copies they sent back to you. There is little point in printing new ones.

What exactly did you send? Assuming this is marriage-based immigration, it should have been:

1. I-130 + supporting documents + $535 check (assuming you did not send an I-130 previously)
2. I-485 + supporting documents + $1225 check
   1. I-765 for an  EAD (optional but recommended)
   2. I-131 for AP (optional but recommended)
   3. No fees on the 2 items above

Checks should be made out to "U.S. Department of Homeland Security".

 

You can resend the same forms.

I sent

 

1) I-130 + supporting documents + wrong fee

2) I-485 + supporting documents + $1225 check to "U.S. Department of Homeland Security"

3) I-693 | Report of Medical Examination and Vaccination Record in a closed envelope (they sent me this back with the envelope opened)

4) I-864 | Affidavit of Support Under Section 213A of the INA + supporting documents

 

They sent me back all the documents, (they are all messed up), and every page has like a code number at the bottom. In both checks the stamped like a seal that says "Department of Homeland Security, Citizenship and Immigration Services".

There's your problem. The I-130 was rejected for wrong fees. As such, the I-485 (and all supporting documents like the I-693 and I-864) were rejected since the I-485 is dependent on an I-130.

I see. I am now just confused about whether it should be U.S. Department of Homeland Security or US Department of Homeland Security, Citizenship and Immigration Services, as I can see on the checks they returned

Always go by what the instructions state: " U.S. Department of Homeland Security"

2. Make the check or money order payable to U.S. Department of Homeland Security"
