File for I-131 after I-485

Hi everyone,

 

I have a question. I filed for I-185 and I-131 in August. My I-131 was approved 1.5 months ago. However, I never received my travel document. I had an InfoPass appointment this week and was told that the post office could not deliver my document. I was further told that NBC no longer has my card. And I will need to submit a new application for I-131 again.

 

My question is, do I have to pay new filing fee? It is very expensive at $660. But I feel like this is not my fault that USCIS lost it. Like, if they failed to deliver it then they should still have it right? I never received it so they cannot fault me for losing the document right? 

 

The I-131 instructions say on page 13

 

"Replacement Travel Document: If you are filing to replace a travel document that was lost, stolen, mutilated, or contains erroneous information, such as a misspelled name, a filing fee is required. NOTE: If you are requesting a replacement Advance Parole Document as an adjustment applicant filed under the fee structure implemented July 30, 2007, then the full filing fee will be required; however, no biometrics services fee is required."

Side note: I turned my maiden name into second middle name. In the combo card, my given name is First Firstmiddleinitial, however on the back of the card, they attempted to list my second middle name.
