Hi, I went to us on a j1 visa me and my wife got married and we lived together during my stay which was 5 months, we filed the i-130 4 months ago and I'm back in the DR  we haven't heard nothing back about our case, she talked to a lawyer and he told her that it'd be better if we annul the marriage and she comes here to get married here because we haven't validated our marriage in the DR and because she hasn't come here yet after 4 months of me leaving usa, if we don't do that he said that it could take up to 4 years for our case to be approved and that she must have 10,000 usd to sponsor me, I don't really think this is all true, he's just trying to get money, correct me if I'm wrong and please tell me if I have to validate my marriage in DR or get married here again? I just want this to be quick and smooth thank you guys help!

you are from Dominican republic right?

is your wife American citizen or LPR?

why the lawyer said that it will take 10 years for her to petition for you?

 

The process cost less than $10,000 if we talk only about fees for the visa.

If everything it's ok with your application is taking 12/14 months (depending on the service center your case was routed) .

Sounds like a crazy person that lawyer that you got. My advice is to search for another lawyer (in case you really need one).

Yes I'm from Dominican Republic and my wife is a us citizen, the lawyer said it could take up to 4 years because we haven't validated our marriage here in DR is validating the marriage really necessary? I don't know if need a lawyer were just desperate and curious waiting for this to be over,  my application seems to be okay since they received it and didn't send a request of evidence they sent us the notice of action to let us know that they received it, and the service center is Nebraska, so what can we do from now on and what can we expect?

Well, if your case was routed to NebraskaSC prepare for waiting between 9/13 months before receiving NOA2.

 

I'm not aware of any specific restrictions for people from DR for validating marriages from other countries.

Try to go to register in DR, and ask the procedures for having your marriage certificate validated. At the worst case, I think it will only need to be processed at the consulate of DR in the US, before you to be able to register it in your home country. 

I honestly don't think it's needs to be registered in DR for your application to be approved. It happened in the US so is registered in there.

 

DON'T DIVORCE OR GET ANNULMENT.
