I know there are two schools of thought. One is a self-sufficient applicant who can file it themselves successfully. While that's true, I want to believe that it's safer to work with an attorney. Those are very important documents, and your life depends on how well you prepare the package. The attorney may not be super useful in the initial filing of I-751. However, an attorney familiar with the case from the start may be very helpful in case you need them later. 

 

In the end, nobody can tell you what to do. If you feel comfortable having an experienced set of eyes look through your documents, then attorney is a way to go. If you want to file yourself, you should be able to do that, too, without any issues.

You only have to look at the number of threads saying 'my lawyer said X, but....' to see that not all lawyers - and law degrees - are equal...

 

 

There are some ridiculously knowledgable people on here, and we are all free, largely as we have all been there with this stuff. 

 

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

I totally agree on this. I learned a lot here by reading and searching. I filed my AOS and ROC on my own and months from now I will file my N-400 on my own as well so I saved and I will save thousands of dollars.

I haven’t used a lawyer for any of my applications, k1 through to naturalization. Seen so many cases on here where the lawyer or the lawyers assistant has messed an application up and have just turned round to the applicant and gone ‘oops guess you will have to apply again’ with no apologies or offer to help.

 

OP what evidence do you have that is listed in the instructions on the USCIS I-751 instructions?

 

(Sorry for the off topic but @Lemon23 totally reccomend you apply for the naturalization online if you can as they are being processed quicker than paper filing)

Hi, may I ask a question? One of my friends wrote an affidavit for me. She actually wrote in hand writing and there's some scribble for mistakes, and she forgot to make her signature. Is this ok or should I ask her to type in and print out and get signature?

I would suggest to type in, print and have your friend signed in. The affidavit letter will be invalid if there is no sign, make sure you have your friend full name, current address, birthdate, birth place and most importantly mobile or any contact number.

I agree on this, that is why I rather choose to do it by myself. I will definitely apply online to less the paperwork, I will save all my evidences so I can have things to bring on the day of naturalization interview :)

Hello, I missed your posting - sorry about that.

 

I have : 2016 joint tax returned, rental agreement, joint checking account statements for 7 month, document for her last name changes at the bank, 

car insurance together, some facebook screen shots, Triple AAA, lots of photo, a couple of letters from her, Her school main page saying that I am the husband,

three affidavits from our friends, Itinerary for our trip to Las Vegas together, I also have bankers statement how I didn't want to sign the paper, but her step mother forced me. 

 

These are all I have.

I have a question.

 

After I signed the paper, I registered car under our both name. I am not sure if that helps. She filed the papers 3 weeks later.

Not a bad list, anything you did after signing the divorce papers won’t really count for much. Who was on the bills at the place you rented, even if you were on some and her on others you can use them to show shared responsibility.

Does text messages to each other can be evidence? Saying I love you or I am excited for the wedding ect...

Just an FYI on attorney.... We have used the same attorney for initial application (I-129) and for AOS (485). We plan on filing ROC at end of July. I already spoke to our attorney and her rate is going to be $1,500. So, I would say that the 3K+ that your attorney is asking is excessive.  We are in Florida. Not sure where you are, but she represents clients down this way.

For ROC, nothing related to wedding is relevant.

For ROC, docs AFTER wedding or AFTER you got your temporary green card are more relevant.

 

I would not include text messages, personally.

Instead, I would show cell phone bill and highlight all the calls and texts you made to each other in the call/text log.

They won’t let you show them a digital device during an interview and printouts of text messages are super easy to fake so I would say not good evidence. With that anything from before marriage wouldn’t be relevant for the removal of conditions
