Green card I-751 Waiver... finding a lawyer

Hi...

My wife is divorcing me. I did everything to change her mind, but since her parents are heavily involved, I can do anything to stop it. 

They threaten me to sign the divorce paper or they said they can cause me a huge trouble regard to my immigration status. I got scared and signed it which I regret so much.

She filed the papers...now it is in the process.

I was depressed for a long time, but I know I have to survive. 

I did research and started gathering evidences.

 

I will hire the lawyer, but I am not sure who is good or not.

I've talk to the one in local, and he said we should start right away. He seemed nice and he asked $3500 fee.

 

At this point, more than money, I want to find someone is really good for sure. My life is depends on this...

 

1. Can you guys recommend any good lawyers?

I tried avvo ratings, and I am not sure how reliable it is. 

 

2. if I can prove that our marriage is bona fide, will it be approved 100%? 

because we loved each other so much. I still miss her a lot. I have evidences, but not a lot.

As long as you entered the marriage in good faith you should be ok. There's no 100% guarantee on anything, but just prepare your evidence. 

 

Also, wouldn't matter if you signed the paperwork, eventually you can get a divorce without the signature.

Why do you think you need a lawyer?

 

An I-751 with a waiver is the same as an I-751 filed jointly, apart from the obvious exception of it being just you instead of both of you involved.

They are both adjudicated on the evidence of bona-fide-ness provided and a lawyer won't change that.

 

$3500 is a hefty fee for doing not a lot.

#2) Yes.

 

What is the lawyer needed for exactly? You can just file the I-751 using the single filer option and provide the bona fide marriage evidence yourself. Once the final divorce decree is obtained, you send that to USCIS.

I am not confident establish the case by myself. It may seem easy, but if I make one mistake, my life is done.(I guess I am being dramatic)

I also read from many immigration websites says in case of waiver, I need to talk to lawyer.

 

So you guys didn't hire the lawyer??

 

The lawyer I talked to said, this is a complicate case and he will need a lot of time. Did he lie to me?

Many people do ROC with a divorce on their own. The process is the same, just with only 1 individual for the interview + a divorce decree being provided.

 

No idea if your case is complicated or not...nothing you've stated sounds complicated, but there's not much to go on.

Is your case just a divorce before you file your I-751? No other complicating factors? 

If so, then yes, he did.

Not impossible to file without a lawyer. However, if you don't feel confident with the quality of evidence of bona fide marriage that you have, then lawyer might be helpful.

Did you pay consultation fee to that lawyer?

 

What type of evidence do you have? What made you worry of not getting approved?

Basically, one day I came home, and she was gone, and told me a lot of stuff that I didn't know that's been going on.

She has depression.

There are a lot of VJ members who filed their I-751 under divorce waiver and successfully approved their application. As long as you have enough evidences of bonafide marriage then you'll be fine.

Thanks... Is there any step by step kind of thing? I know they have application and instruction for I-751 online.  Is that enough?

You can find immigration attorneys through the American Immigration Lawyers Association. I'd also check on your state bar association website whether the attorney of your choice has a clean record.

I'm not sure how complicated your situation is but as long as you have enough evidences of bonafide marriage then you dont need a lawyer. You just need to follow what ever the instructions written on the i-751 instructions. Fill out the form and make sure you will choose the divorce waiver on the form since you're filing your i-751 alone,  meaning no USC wife involve. If you have questions on how to fill out the forms, VJ members here are more willingly to help including myself. Note that it might be a tough crowd in here since some member here will give you some BS as I encountered some of them but just ignored them since majority here were helpful. Gathered and print all of your evidences. If you dont have your final divorce decree, its fine since it can be sent to follow once you have it. Be positive, I know its tough but you're the only one who can help yourself by being positive.

First, I really appreciate your comment. My case is not complicated. I came home from work, and she was gone... 

There was no violent or I don't have any records. I never even had a speeding ticket in my life. 

It is just really stressful. I will keep looking into it. Only reason why I am looking for a lawyer is to make sure I don't make any mistakes.

Just make sure you follow the instructions on the i-751, it's pretty straight forward, but then again if you're doubt or have questions then come back here and ask.
